If she did have a rape kit done that night (hopefully she did, but don't think it was mentioned conclusively in any articles I've read), the results should be enough to get charges and take this to trial...IF the girl is willing to go through a trial. I think that is the biggest question right now. If they see that they have physical evidence via a rape kit and medical docs, her testimony would likely make a conviction a near certainty. With just the medical evidence but no willingness on her part to testify or push the matter personally, the chance of conviction goes down and they probably don't press charges.
She did, and the DNA matches. But Winston is claiming it was consensual.
We have an intern here who goes to FSU. Sounds like Jameis is going to be cleared soon. What he relayed to me sounds a lot like the Hyde situation, where what was reported to the police by the victim is a highly exaggerated version of what really went down, and may border on filing a false report.
We will see what the overall outcome is, but the general consensus is that he will be cleared of any charges sooner than later.
I think it's likely the case will be dropped; but I don't agree that it's in any way comparable to Hyde's situation.
In Hyde's case, the police did their job and properly investigated the incident immediately
In Hyde's case, there was definitive evidence to vindicate him (video)
In Hyde's case, he was still suspended for 3 games** and that wasn't lifted despite being vindicated
In Hyde's case, it was all wrapped up in a typical timeframe
None of that is the case here. We'll never know what really happened b/c of the lack of evidence either way, thanks to the police refusing to do their job. It may be the police had reason to believe she's full of it -- but that's not their place to make that call. Their job is to investigate regardless so that the Lawyers can make that decision; or if it goes far enough a Jury. I'm sure a lot of the cops in Columbus are Buckeyes fans; I'm sure police in Columbus get a lot of false reports; but they still followed through with procedure and did the right thing. Tallahassee Police Department didn't, and their actions effectively threw the case in Winston's favor.
That doesn't prove Winston did it, it doesn't mean the TPD had ulterior motives either... it does mean that without some really strong evidence either way (outside of witness affidavits provided 11 months after the fact), that we'll never know the truth. If I were the victim***, I'd consider the unlikelihood of pursuing a case against Winston - and perhaps instead begin Civil Proceedings against the City and Tallahassee Police Department. In that respect, she could have a very strong case.
** And Urban Meyer isn't the only one to be proactive about such things. I remember in January, Mack Brown sending McCoy home early for allegations that were subsequently dropped
*** which assumes the victims story is truth, b/c I'd never make some bs like this up
