Jameis Winston (QB Browns)

It's my opinion he'll be charged with rape or sexual assault the monday or Tuesday after FSU accepts the BCSCG invite.

I also believe he's guilty.

Did anyone else watch his post game interview this week? I'm sure he'd be stressed even if he's innocent. But damn. He just looked and sounded like a kid that thought he'd gotten away with something, only to have it catch up to him when he was living the dream. Everything about him in the interview was weird.

If I end up being totally. ..or even partially wrong, I'll post my mea culpa in this thread.

I really don't see him being innocent.

It sucks that either he's been wrongly accused of a horrible crime during one of the best years of his life, or a really talented kid ruined his life to get laid. A kid that could have found a thousand other women that would have slept with him without him even asking. Fucked up.

Because the investigation was botched; the case is dead.
Winston has 2 witnesses. She has a PD that refused to investigate on the claim that it'd tip Winston off; then immediately proceeded to inform Winston's lawyer.
Unless there are Medical Records that can verify her resistance; it's 3 peoples word against hers.
Winston had 6 months to concoct a fool-proof story -- and that story cannot be compared to testimony in the immediate aftermath b/c Police refused to do their job.

The only conclusion I've reached is that Tallahassee PD is incompetent.
The DA said as much when this first hit the news.

If Winston is innocent, this will likely still hang over his head b/c of how it was botched.
If Winston is guilty, it's unlikely he will be convicted b/c of how it was botched.
Both are travesties... and it goes back to the fact that Tallahassee PD didn't do their job when it happened.

When i went to UF they told us in orientation that in Florida drunk people are incapable of giving consent. So dont have sex with a drunk person, because you can later be charged with rape. I dont know the specifics or precidence, i just know thats what theytell us is the law in florida. As far as i know it is rape to take advantage of a drunk girl, even if she wants to.

I am saying that you can't discuss the how likely a conviction is without knowing the facts in the case. For example, as TampaBuckeyes accurately points out, if you are intoxicated or have been drugged, by law you can not give consent. That makes the results of the toxicology reports very important.

Facts:
- As per Prosecutor / Victim / and Winston... Police did not interview anyone except the victim until recently
- Police informed Winston et. al. of the case back in February - corroborated by Winston's lawyer.
- Winston's own lawyer has stated their defense, supported by 2 witness affidavits, is that it was consensual
- Without ability to compare witness affidavits to testimony in the immediate aftermath, Impeachment will be near-impossible. By default, their testimony will stand as-is and be taken at face value.
- The family and police have verified she was not drunk.
- According to Prosecutor, Police, and Victim's lawyer it is not clear if she wishes to pursue the matter.

As I said, that leaves a very narrow window requiring "Caught Red Handed" evidence. Such as a Medical records showing bruising or cuts or something from the time when the rape kit was administered.

I can reach all kinds of conclusions without every single fact. In fact, I'll do it right now.

Without knowing which players on which team will not play due to injury or suspension or having an accurate weather forecast, without knowing if any player on either team will be nervous, scared, or sick on the day of The Game...

C'mon man. Two weeks ago tOSU was starting a walk on at LB. If that happens this week, or anything like that...there could be students from BlockO playing by the third quarter.

And yes, the first number represents tOSU's touchdowns and the second number is tsun fan attempted suicides from jumping off of the top of the stadium. When they land, they will not be granted the sweet release of death. Just more crushing disappointment as they wake up in a full body cast and slowly come around to the bleak realization thar their shitty stadium is only twelve feet off the ground at it's highest point. That will lead to an even worse reality...that the pain isn't over and they'll have to live through the next edition of The Game, Brady Hoke is still their coach, Urban still resides in Columbus, and The Game will be at The 'Shoe.

Also think Iowa finished the job in tenderizing that dumb slab of meat they call a QB and it just isn't public yet.

What has Winston's supporting witness attested to in these affidavits?

How can Winston's witnesses support his contention that the alleged victim gave consent?

What was the alleged victim tox reports? (I have not seen any news reports that deal with the issue of if the alleged victim may have had a "date rape drug" in her system.

The alleged rape took place in December. The alleged victim and police did not identify Winston as the suspect until the following January. How does this fact support the claim of rape or the claim of consent?

A rape kit analysis was preformed at a hospital. What will the health care professionals be willing to testify to as to the alleged victims state of mind 4 hours after the alleged rape.

These are just some of the questions that I believe need answers before anyone can opine on the success of this case.

Lastly 2 comments on your facts

1) The victim attorney has stated that she never wanted to "not pursue" this matter. She did ask some space at one time to seek help from rape counseling.

2) I think you are wrong about the Winston's witnesses statements standing as unimpeached. First off, since we don't know what these statement are it is impossible to say if they can't be impeached. Second, my sense is that Winston's lawyer is doing what any lawyer would do in a high profile case such as this one. That is put a narrative out to the public that supports his clients story in advance of any charges being brought. Lastly, at the very least any prosecutor would try to impeach a supporting witness on the basis that he is lying to protect a friend.

Are these two witnesses his best buddies? I'm sure on that campus they could easily find a couple thousand people that would testify they watched them having consensual sex.
