Well, innocent until proven guilty. There is no NCAA uniform standard of how to deal with a player who is subject to an ongoing police investigation, so it would depend entirely on school policy and/or the coach's policy.

What a joke of a f%#&ing university if this guy takes the field in Saturday. We're talking about a suspect in a violent sexual assault who has lawyered up and, based upon that lawyer's counsel, is refusing to speak with police. How do you justify his playing?

my guess is the following: if they suspend him now, pending an outcome, and fsu wins out and gets to the title game, they can't possibly play him in the title game if the case isn't resolved. if they say fuck it, and play him the whole way through, they can justify him playing. that is of course, if he's not formally charged first. but, i strongly suspect if he is going to be charged, it will miraculously happen after the bcs title game.

Outside the context of detention or arrest, a person has no duty to answer any questions of police at all; and if judicial compulsion is sought by the State, the person still can invoke his Fifth Amendment privilege against compulsory self-incrimination, and refuse to comply. Only if granted immunity by the state, in a formal proceeding, from having any testimony or evidence derived from the testimony used against him, can a person be compelled to answer over an assertion of this privilege. Kastigar v. US, 406 US 441, 462 (1972). If police detain (or arrest) a person, they must advise him that he has a right to remain silent, and the right to an attorney, among other rights. If the detained person invokes these rights, all interrogation must cease, and nothing said by the defendant in violation of this rule can be admitted against him at trial. Miranda v. Arizona, 384 US 436, 448–50, 455 (1966).

I fully expect them to try but given the nature of the accusations I'm holding out hope (for human decency, not football) that there is at least one reasonable human in the FSU camp that has a moment of clarity about this.
If this is true and you look the other way in favor of football what makes you any different than Penn State or Notre Dame?
