Duke lax and accusations

Ummmm... the lack of DNA evidence here is not at all surprising to me.

Some of the allegations here are that the players were changing their names to confuse their identity. When I heard that, I was surprised to find out that they would have left any DNA evidence at all. I mean, why go to such lengths to hide your identity only to give up the best evidence possible to establish your identity? They seemed to have covered their tracks pretty good on one end, so why wouldn't they have on the other?

Something's still not right here.

Yup that's it, those Animal House drunken frat parties with strippers are soooooooo well known for their attention to detail. I am sure that after two kegs they were able to get every hair and bodily fluid out and off of a drunk stripper and fool them silly ol' DNA tests. OJ, is that you?

The cops and the DA look like they jumped the gun and said stupid stuff in the press after they found the e-mails. Well, it sure appears to me that the e-mails (while cryptic and demented) were not the smoking gun evidence they thought. I am sure that the DA has stained himself when the DNA test came back negative. He is screwed unless there is more.

The DA has No positive ID. No hard evidence.

The Defence has hard evidence of pictures showing she had bruises before the alleged rape took place. The players stories so far have been proved true with DNA tests to be accurate.

Clearly these guys were freeken animals. But it sure appears that the thing that is not right is that no one expected this girl to lie (allegedly) and ruin the lives of multiple men.

Public perception of this case has been based on stupid prosecutor and attorney statements, and momentum - which is on the defense side now. But I'm saying that I don't think this may be over just yet. It could. It couldn't. Maybe we should all reserve judgment until and unless the prosecutor states he is not pursuing charges or until and unless there is a conviction.

As far as the DA goes... I posted this on the second page of the thread.

This sounds like a real fucked up situation. But this is inappropriate:

"If it's not the way it's been reported, then why are they so unwilling to tell us what, in their words, did take place that night?" Nifong told Smith on Thursday. "And one would wonder why one needs an attorney if one was not charged and had not doing anything wrong."

He's not supposed to make his case to the public and the media, especially where a potential jury pool could be tainted. These are arguments he couldn't even fucking make in court. This District Attorney should be reprimanded and taken off the case.

I thought that you were insinuating that the kids had either cleaned up the scene or did it in cooperation with the police. On ESPN they had some community members saying that they thought that the evidence was tampered with, a la OJ and that the kids were guilty no matter what the evidence said.

I completely agree with you that we need to wait till the evidence is in. I think this entire thing could go either way still. I just wish the University had done the same thing.

From one of the earliest articles on the situation, almost 2 weeks ago:

Durham County District Attorney Mike Nifong, lead investigator in the alleged rape case involving the Duke men's lacrosse team, said Thursday that he expects to file charges including first-degree forcible rape, first-degree kidnapping, and first-degree sexual offense, if the case can be made based on the gathered evidence.

I wonder if there is other evidence that hasn't been discussed, or whether the DA totally screwed up when he said he "expects to file charges." Did he only base his belief that a crime had occurred on:

a) her word, and
b) the bruises and scratches on her body, which the defense now claims show on time-stamped photos upon her arrival at the house?

It's always a mess when cases get tried by the media - which seems to always occur whenever sexual allegations are involved. And racial overtones only add to the frenzy.

On Monday, attorneys representing members of the lacrosse team said DNA from 46 lacrosse players did not match evidence collected from the woman who says she was raped.
"No DNA from any young man tested was found anywhere on or about this woman," defense attorney Wade Smith said Monday.
He said he hoped Nifong would drop the investigation.
No charges have been filed in the case, but Nifong has said he believes a crime occurred at the March 13 party, which according to court records was attended only by lacrosse players.
Nifong, who has said he doesn't necessarily need DNA evidence to prosecute, was calmly defiant at Tuesday's forum, attended by about 700 people on the campus of North Carolina Central University, the historically black university a few miles from Duke where the alleged victim is a student.
"The fact is that this case is proceeding the way a case should proceed," Nifong said to applause.
The 27-year-old woman told police she and another woman were hired to dance at the party. The woman told police that three men at the party dragged her into a bathroom, choked her, raped her and sodomized her. The allegations led to days of protests on and off the Duke campus.

Sorry, this looks like a cover my ass speach. Dude is playing the race card and looking for support. Normally this speach happens on the steps of the courtcouse or the police station and not at a Black school where there were obvious tensions prior to the alleged crime.

What a cluster fuck.

This whole situation is bullshit. Classic case of reverse discrimination. Ever since this came to light, everybody seems to have been ready to nail the "white boys." Not only is this case horseshit, it's taken down alot of innocent people in the process.

Fuck that "ho" hope she rots in hell.

I conferred with a couple buddies today to get the "OK" on this. Both are regular visitors to my house, cool as the Arizona sky, and Black as the ace of spades. "N" Bitch cried, "N" bitch lied, "N" bitch needs fried. Peace.

While I agree with the sentiment I want to hear all of the information before I make a descision. By the looks of things this girl might have some serious mental issues that have nothing to do with the Lax party, or she could even be telling the truth.

A source has provided ESPN with a detailed account of the exotic dancer's arrival at the hospital the night of the alleged sexual assault at a party thrown by members of the Duke men's lacrosse team.

The source, who asked to remain anonymous, was present at the hospital on the night of the alleged incident and says the woman was "beat up" but would not immediately divulge to anyone the identity of her alleged assailants.
"She was hysterical," the source said. "She was crying, she was pretty banged up. She said she was sexually assaulted, but she didn't say by whom."
The source says the woman entered the hospital well after midnight March 13 wearing a red nightgown and nothing on her feet. She was walking on her own, but there were bruises on her face, neck, and arms.
A triage nurse attended to her, but the woman did not want him to touch her because he was a man. She was then examined by a sexual assault nurse.
There were injuries to the woman's pelvic area, the source said.
According to the source, the woman did not immediately inform either the police or the hospital staff who inflicted the injuries to her.
"She never said one thing about Duke, any athlete or anything," the source said. "She just kept hollering and screaming. She never said who did it."
The woman was discharged after approximately five hours.
No charges have been filed.
