Name, Image, & Likeness (NIL) at tOSU

Yeah, I saw The Foundation shitshow coming a mile away. This was nothing more than Little Lord Schottenstein's vehicle to buy some athlete friends and weasel some influence over the athletic department. If there's some actual criminal graft thrown on top, it won't surprise me.

The only way to kill this shit is, at this point, to make the players employees under contract. It's only a matter of time.

Do universities have the appetite for the union that will be coming shortly behind that?

That's the real question imo.

They'd probably view it as the lesser evil over the unregulated cooperatives. Sad thing is that all of this shit could have been avoidable had they and the ncaa simply put a regulated plan in place for NIL. Instead, they thought they could maintain their archaic pay for free model and tried to fight it in court.

The Smails kid doesn't seem inclined to leave the lodge and Zach Smith can't afford a pair of skis (to continue the metaphor). I think we are safe from any high speed crashes involving these two.

If we get our NIL machine going hopefully guys like The Schmails kid and Zach Smith don’t get out over their skis.

I think many saw this coming a mile away, and is a reason why OSU didn't want to get into the "paying kids up front" game...
I've said before that its a recipe for disaster to give a HS kid 7 figures when he isn't even signed up for classes. Yet the backup on the 2 deep will barely see high 5 figures and a deal for free hot wings

I think it's part of the evolution and how some teams adapt quickly and effectively while others fall off. The money isn't going anywhere, the disparity in money isn't going anywhere so how do you make it a functional situation? All pro sports have a similar issue and there are good cultures and bad ones so it can be done. Are you going to deal with the new reality and make a plan or stick to the framework of yesterday? The fact that the kids are so much younger is a big part of the unknown on how to handle it.

I've said before, I love situations like this myself because it means everyone just has to compete on a level playing field. No one has any inside track. No one has any experience that you don't have. It's a just a brains and balls competition.

When CJ said that the players should get a cut of the media deal, I don't think he fully understood what he was asking for. That would not be simply another check rolling in for these guys. That would absolutely trigger a formal employee-employer relationship with employment contracts stipulating what outside endeavors the employee may and may not engage in. And Kavanaugh's opinion on control will turn on a dime the moment this stops being a deregulation issue and starts becoming an employee rights issue.

I think CJ watches TV like every red blooded American, and sees the salary's of his HC and coaches around the nation, and also sees how large the TV rights deal will be. And I'm sure he's wondering why aren't the guys risking their bodies getting a cut. I don't blame him, and I'm sure he wouldn't care about some employer-employee model, just like the coaches and admin don't, and they don't have to shake tackles from 300lb DL.

I also hear what you're saying, but I'm sure schools would rather be in charge of paying their players than the already shady guys who were giving players money in duffel bags. They would at least have some control, and not have to converse with collectives over the players they want

We'd need a labor lawyer to shed insight but regulating outside income on an employee isn't as simple as all that, contract or no.

For instance, let's just say it becomes and employee/employer relationship and OSU decides to be very restrictive on outside business activity on their employment agreements (to eliminate the bag men influence). What happens when an SEC school doesn't include those type of restrictions in their employment contracts?

The genie is out of the bottle on this. I don't think finding ways to restrict is the right path. You need to find ways to use the money to align the players interest with the employer/school/team interest. I don't care what field of work it is, that is always the better way.

O’Bannon is a bastard. Pretty sure all of this nonsense started with him. Yeah, I’m sure it would have hit the fan eventually regardless, but still. :lol:

I just hate all of it. Count me in the camp that considers a paid education and the opportunity to go make millions at the next level more than enough. Prove it on the field/court/etc. and enjoy your free ride.
