Check with real lawyers but I don't think a non disclosure applies if you are subpoenaed. Overall I agree, any dime he gets is going to come with an NDA attached.

It just comes down to what each side sees as risk reward. maybe tsun just says pay him, sign NDA and go away-maybe they realize they have 6 million reasons to take a shot at squeezing him. Maybe they have a lead pipe cinch smoking gun that they can fire him for cause.

If they did want to play hardball-he'd end up settling for less than the 6 million. It's just the nature of the game. Somewhere between $0 and $6MM is a sweet spot to mitigate the risk they might win and, more practically, spend the money to fight them to find out.

Anytime litigation gets to an actual trial of any sort, according to every lawyer I have ever known, it's 50/50. So what is the number you are willing to bet on that coin flip, what is the number you are willing to spend to get to coin flip day and what can you afford to lose? tsun can lose and afford to pay his $6MM a lot more comfortably than he can afford to spend a few hundred grand on lawyers to possibly lose his 6 million.

Litigation is like playing poker. You don't want to be short stacked because the bigger stack guy can just lean on you.

Just sayin': You could be right; however, I still believe that he gets the whole $6M with a non-disclosure clause (i.e. agrees to keep specific confidential information private and not share it with unauthorized third parties). He knows everything about the whole cheating scandal, i.e. who know what, who did what, and when they did it. If the Partridge case ever comes to trial scUM wouldn't want to see him on the stand, especially if he is pissed off because he got a settlement that was less than his contract, i.e. $6M. The difference between the $6M and a lesser amount that he would be would just be "chump change" given the millions (plus other intangibles) that the cheating scandal has already cost scUM. Besides scUM doesn't want to give the NCAA any reason to reopen the investigation.

Have migrated from the 'anxious as heck' to whatever. I like the stable of RBs currently on roster, but acknowledge that DGG might be special. tOSU has had more than our fair share of RBs that made good history. Except for Troy, all of our Heisman winners were RBs. tOSU will be fine whatever he chooses. If he goes to UT, then he'll live in a cloistered environment, and probably won't worry about the outside environment. Plus with the loot he'll draw, he can hire a limo and body guards to accompany him wherever he might go. Though do admit am wanting to see how far up the recruiting ladder he'll take us if he commits to the good guys....

ANOTHER BIG LEAGUE BUCKEYE. In Monday’s Skull Session, we shared the news that the Seattle Mariners selected Ohio State catcher Mason Eckelman in the eighth round of this past weekend’s MLB draft. As it turns out, Eckelman won’t be the only member of last year’s Ohio State baseball team – or the only member of his family – joining the Mariners organization.

Ohio State shortstop Henry Kaczmar, Eckelman’s cousin, signed with the Mariners as a free agent on Monday. It continues what’s been an intertwined baseball journey for the cousins since high school, as both attended Walsh Jesuit High School before enrolling at Ohio State.

Kaczmar’s MLB opportunity comes after a senior season in which he earned second-team All-Big Ten honors. Kaczmar hit .316 for Ohio State last season with 12 home runs, 26 doubles (a single-season program record), 47 RBIs, 50 runs scored and seven stolen bases.
