Storm is not likely a public figure. The more important ids he in this case would be whether it is public or private concern. I seriously doubt you could get summary judgement. Maybe a settlement.

It would be a public concern, but under Ohio law, the standard is negligence, not actual malice. SI would probably argue that Storm is a "limited purpose public figure," but that requires a showing of voluntary action into a matter of public concern. That's not the issue here with Storm Klein.

It would be an intriguing suit. It could be filed in state court; would probably be removed to federal court; venue would be in Ohio with an Ohio jury. I could see a case here. Not a strong one; but not a frivolous one either.

Over/Under on how many consecutive days an Ohio State football story will end the day (so midnight) on the frontpage of ESPN.com?

We're going on five (understandable), but I'd set the line at 9 1/2?

At this point, I say we just shoot for taking over the entire main CFB page so that every picture, article, blog, and link is about Ohio State. We've currently got 3 of the 5 video links, 5 of the 11 free headlines, and 3 of the 5 premium Insider articles. I think Tressel should drive to Bristol and drop a deuce in one of their satellite dishes.

Notice that the SEC had to do something completely radical (limit signing to 25) to even weasel in on our coverage. Those slick assholes in the SEC never cease to amaze me!

I know I've gotten some shit for "defending" the media on here (and I understand why). But SI and ESPN have reached new lows in journalism as far as I'm concerned. The SI article was written like a damn tabloid. There was so much potential meat to the story that it was hard to ignore, but there was not even a shred of objective writing in that story. Not only that, the article appears to have so many holes that it's hard to even consider it credible at all.

ESPN just keeps getting worse. Nothing more needs to be said about that.

I understand getting the first scoop, but you'd better fucking make sure what you're reporting is true.
