It's my understanding that is was not a dirty bowl or bong, just a stupid roach clip.

If that is the case, the officer should get a freeken life. Do something positive for society like park cars, cut grass or wash dishes for a living.

Act like a civil servant, not a douche bag.

Absolutely. Pick and chose which laws you'll enforce, then get criticized when you don't pick the ones that people like Folanator agree with.

Have you ever driven a car and had tweasers or forceps in the car with you? Because those could be considered drug paraphernalia, commonly items used as roach clips. It could even be large paper clips. If you get picked up with drugs you almost always see the paraphernalia charge go with it, as it gives prosecutors more leeway with dropping charges to secure a plea of no contest or guilty.

Now I am not saying that I know any fact of the case, just that when I read they were charged with nothing but the drug paraphernalia charge, I wonder what they were actually caught with.

It's called common sense, a test this officer obviously did not pass. Sorry, it's stupid and a waste of time and money. No way to candy cote it. We have far bigger fish to fry these days to waste resourses on something this trivial.

Can he/she ticket them for a roach clip? Yes.

Should they? No way.

Heck for all we know it could have been hanging on his mirror since HS.

Likewise, cops are not required to credit any story which tends to exculpate. All you need is evidence of the elements to the charge. I think I know what you mean, but you're not required to prove guilt on an arrest or citation.

An officer can, and they do, arrest on what they "feel" That is to say, there are some arrests which are discretionary. While one might get clipped for drunken disorderly after several warnings, another might get clipped without a warning.... and the mere fact that one person was warned does not constitute any waiver with regard to the second. Ultimately, what you're saying is true, though. You are prohibited from simply walking up to me and arresting me for an offense if you have no probable cause for the charge. It does have to do with what you believe proves an element of the offense (whether that "proof" stands up in court notwithstanding)

In other words, you're arguing that the citing officers didn't just decide "Hey, lets throw a charge at these guys" for no reason at all. In their minds, on the scene, there was enough supporting a charge of drug paraphernalia. Whether the crime had been committed in fact is another matter and cops are not charged with a duty to only arrest those who are guilty.
