I believe you are correct that the officers could have just as easily decided NOT to charge either with any offense.... indeed, they could have easily said "Hey, be more careful and don't run stop signs" without citation.

But, I think you're barking up the tree of absurdity when you're saying anything about what fish need to be fried and by whom. For all we know, Shugarts and Adams went in to the whole "Don't you know who I am?" routine before the cops decided to cite them....

Could have let them go does not turn in to should have let them go just because you think the charge is "petty" and I see no problem with the citation even if it proved to be (in Adams case) factually non-sustainable.

Any time you buy zip lock baggies from the grocery you have potential drug paraphernalia in your car. If you're also suffering from hay fever, and only ran to the store for the baggies (and not other things too), run a stop sign and get pulled over, maybe you'll even get cited for it......

Of course, you wouldn't be guilty of the offense.....

A law may be a law... but facts are facts.

So you're saying if I buy a scale on the same trip that I buy some sandwich bags and paper clips, I may have some trouble if I get caught running a stop sign ?

Quite possibly. Cops don't know what you're up to... they see baggies... red eyes (hayfever) and a scale.... They also are not required to dig up exculpatory facts (they can't willfully ignore them, they just don't have to go looking for them)... the elements for the charge are either present or they are not.

Being guilty of the charge, however, is quite a different matter.

Like I said, nobody appreciates the job that the police do more than I do.

But I sat on the side of the road in the back of a police car for an hour and a half because I had two scales in my back seat. The guy even told me they were trying to figure out what to do with me. I said "How about letting me go?" and he laughed.

Thxs. I hope its not a urine test. Thats a type of test for parole/probation or for workers at most jobs. That would be against the law, Marijuana can stay in the blood for 10 to 30 days. So how can someone be considered guilty from last month bong time.:biggrin:
