Appeals Court rules against ex-coach Mike Leach

In summary Texas Court of Appeals tells Leach that Texas Tech is a sovereign entity, that he should have known better than to make the arguments that he chose to make in front of the bench, and that Tech was within it's rights to fire him as they did.

Oh, and forget about monetary damages ... stupid.

Leach plans to appeal to the Texas Supreme Court to try and get that elusive 800K bonus which is the primary monetary gripe between him and Texas Tech.

Office Supplier: "Hey - Tech - you gonna pay me for the two thousand ink cartridges and the 10,000 reams of copy paper we sold you?

Leach: Wasting away again in Margaritaville...

Still an outsider, Leach finds peace at fringes of football

For now. Meanwhile, the Pirate is content displacing Jimmy Buffett as Key West, Fla.'s patron saint of laidback. Prior to his final season in Lubbock, Leach and his wife Sharon bought a three-bedroom bungalow as a second home in Key West. By the fourth day of an offseason vacation, the Leaches had enrolled their children in school. Now they're permanent residents. Leach doesn't own a car. Transportation means walking or riding his bike.

Hey, he is a pirate parrothead, it could be a lot worse.

SI.com has published an excerpt from Leach's forthcoming book:

Mike Leach: My biggest regret was not cutting Adam James

Mike Leach took Texas Tech to new heights, going 84-43 in 10 seasons, including an 11-2 finish in 2008. Leach was fired by the university in December 2009 after being accused of mistreating receiver Adam James, the son of ESPN broadcaster Craig James. Leach has denied any wrongdoing in the case. Here is his account of the incident from the his new book, Swing Your Sword.

Bingham reported her findings to Anders, Bailey, Myers, Turner, and Hance, and did not recommend that I be fired. Hance called me to say that some members of the board of regents wanted me fired because of Craig James' complaints. Hance said they were going to take some sort of disciplinary action against me even though he couldn't explain what I'd done wrong.
The day after Christmas, two days after Hance told Anders and Turner he was going to fire me, I met with Myers and Bailey.
I told them I was happy to cooperate with the investigation. They handed me a letter dated December 23, signed by Bailey, acknowledging "the allegations by the James family had not been substantiated" despite, or perhaps as a result of, Ms. Bingham's investigation. They then told me I needed to sign a letter admitting wrongdoing on my part in the "mistreatment" of a student athlete. I told them I was innocent and I would not sign that letter.
We went back and forth for over an hour. They kept trying to get me to sign the letter and admit that I did something wrong, when they knew that I didn't.

Yeah. "Mr. attorney - er, I mean Coach - could you sign this letter admitting you mistreated a student athlete after we already told you we were going to fire or discipline you?" :slappy:

You have to forgive me for clicking this link, but I was curious how ESPN would report on the revelations from the Leach book excerpts. Pretty bland, and rather misleading:

LUBBOCK, Texas -- Former Texas Tech coach Mike Leach on Tuesday offered up fresh details on what he says was happening behind the scenes around the time he was fired.

In excerpts from his book, "Swing Your Sword," Leach said emails "suggest" there was never a university investigation into allegations he mistreated a player, receiver Adam James, with a concussion but rather "an effort to sell me down the river." He also claims a public relations firm, Spaeth Communications, was used by the university to "smear" Leach's name.

"They knew the facts weren't on their side so they used Spaeth to spread misinformation and try to turn public opinion," an excerpt says.

The university fired Leach in December 2009 amid claims that he mistreated James, son of Craig James, an ESPN analyst. Leach has long denied that and said he believes an $800,000 bonus he was due was the reason he was fired.

Leach sued the school for wrongful termination but a Texas appeals court allowed his trial to go forward for only non-monetary damages.

Leach, who has lived in Key West, Fla., since shortly after his firing and was passed up for the job Maryland early this year, is awaiting word on whether the Texas Supreme Court will review the appellate court's ruling. If the high court reverses the appeals court and rules that Texas Tech waived sovereign immunity protection by its conduct, Leach's suit could go forward for monetary damages.

Texas Tech's response to Leach's petition for a high court review is due Wednesday. Leach has filed a separate libel suit accusing ESPN and Spaeth of slander.

Still waiting for ESPN to get what it has coming to it...

... sure would be nice if they were subject to public records laws.
There is always the anal probe known as the "shareholder derivative suit" :p

I hope Leach gets a judgment against PonyExpressBoy and ESPN/Disney. Hell, if the Buckeyes boycott Disney and ESPN effectively enough, maybe some right thinking soul can sue Disney on behalf of an aggrieved shareholder to get to the bottom of ESPN's policy/decision making practices in continually going after you guys. :banger:

Effective boycott would never happen. ESPN practically has a monopoly. (hmmm... which has me thinking "anti-trust????")

Bruce Feldman Suspended Indefinitely By ESPN

ESPN college football writer Bruce Feldman was suspended indefinitely during a conference call with three ESPN officials this morning.

ESPN Vice President and Director of News Vince Doria ESPN THE MAGAZINE Editor-in-Chief & ESPN Books Editorial Director Gary Hoenig and ESPN.com Editor-in-Chief Pat Stiegman participated in the conference call and were behind the decision to punish Feldman.

Doria, Hoenig and Stiegman informed Feldman today that he has been banned from writing for any ESPN entity, is forbidden from appearing on any ESPN platform, is not allowed to Tweet from his Twitter account nor participate in any promotion of a recently-released book in which Feldman played a role.

Well before Mike Leach was terminated by Texas Tech in late 2009, Feldman had agreed in principle to assist the coach in compiling material for a Leach biography. That biography, in which Feldman was mostly charged with recording Leach?s first-person account of his life, was released this week with the title, Swing Your Sword.
