Jameis Winston (QB Browns)

Question for our resident legal beagles: So it's going to a civil suit - can the alleged victim go after money Winston might earn in the NFL? Can she sue the university and Tallahassee PD for their negligence? OK forget the second question. You can sue anybody for just about anything, the question is would she stand a chance if she went after the PD or the school, both of whom I would presume to have deep pockets. At worst, sounds like she could get some get-out-of-town cash and have her school loan debts settled. At best, she gets the Heisman trophy, a huge part of his signing bonus, travel funds from the school and a get-out-of-jail free card from the PD.

There are immunity issues with suing Florida State and the Tallahassee PD (I don't know that Florida has an immunity statute like Ohio does, but I suspect so). In that event, she'd have to establish more than negligence. That said, and without knowledge of Florida's particular laws on the issue, I would think she stands a fair chance to succeed as against both - certainly against the TPD and the idiot Cop who recklessly decided to do nothing and probably also against Free Shoes so long as they are outside of the statutory time in which an investigation should have been conducted (I don't know that there is such a time, but I'd imagine so. I think I've heard a year, but I can't recall if that was Free Shoes, scUM or both.) I think she'd fair better against the TPD than she would against Free Shoes.

As against Winston - She gets a judgment against him and he has to pay it. She doesn't have to go after any particular signing bonus or whatever. If she wins 2 Million tomorrow, Winston owes her 2M His current ability to pay is irrelevant.

Not sure what the interest rates are in Florida on a judgment, but might as well let that build up in the meantime.

Report: Florida State QB Jameis Winston cited for stealing crabs from a Publix
Early Wednesday morning there were some rather odd reports coming out of the state of Florida that Florida State quarterback Jameis Winston had been arrested for stealing crabs from a local Publix. Originally the reports were thought to just be something stirred up on a Florida Gators message board, but now James Cameron from ESPN Tallahassee in confirming that, while not arrested, Winston was cited by police for the act in question.

It's not like he has had any legal issues before this:
Winston has had previous run-ins with the law, but no arrests. He was investigated for an alleged rape, but the State Attorney declined to bring charges due to a lack of evidence. In November, the associated press reported that Winston was questioned about his involvement in a long-running BB gun battle, and that a Burger King reported Winston was stealing soda in a ketchup cup.

This is great: "He got an adult civil citation," a trusted source inside Tallahasse Police told Tomahawk Nation. "If he completes the sanctions it will never show up on his record. They commonly give them to juveniles on first criminal offenses. They are now doing it for minor misdemeanors for adults to lower crime rate".

Don't do anything to actually reduce crimes, just change the reporting to lower the crime rate statistic. :roll1:
