GP;IAWhen the incident takes place this guy was just a red-shirt frosh, right? Hard to imagine the girl was digging for gold.

That's really the long and the short of it.
Andy Staples from SI has a good summary of the evidence here:

I'd only add that she was at around .10 BAC, which is over the legal limit. She would have been "drunk" but probably not "black out" drunk.
None of us were there.
The whole thing reads like a law school competition fact pattern, where you are assigned a side and have to give it your best argument. You can skew things to fit either story, but neither is clearly right. True version of events probably lies somewhere in between.
I'm pretty sure anything she told police could be used to challenge any testimony she would have given in court.
Same with those affidavits from Winston's team mates.
That said, Winston has never told his story -- and likely never will.
I think the tickets sold out pretty fast.
Winston's teammates Darby & Casher have acknowledged watching the sexual events, asking for sloppy seconds and participating in previous gang-bangs in the apartment. Now, perhaps, they will release their cellphone videos and they can be included in Jameis's Heisman Highlights Films.
If the Heisman Voters are suitably impressed, Jameis may have it all wrapped up now.
