He also claims the former HOA management company has all the proof. When confronted with the truth that the HOA management company (which he fired) sent him all the records via certified mail which he signed for and do not have any duplicates all of a sudden homeboy decided $3,000 not $18,000 would be the penalty. Our son in law's attorney suggested that fighting this probably will be more expensive than just paying the guy off. My son-in law's response..."He can rot in Hell before he gets a cent out of me." Stay tuned...might have a counter suit...

Well, normally in this case, if they have a regular meeting, the equivalent would be make a motion to audit the HOA's accounts. I'm not real sure why the President of the HOA is handling this, and not say, a Treasurer or Secretary. I'm imagining homeboy wants no part of that.

Look, I realize they want to kick his ass, but usually fraud really fucks them up.

Also remember that if this guy is just trying for a shakedown (which is certainly sounds like) he's not going to want to pay for his side of a legal fight. Pursuing him personally might be a good course of action to get him to back off.

Update-Well he was supposed to present the evidence tonight to my daughter's legal team. Surprise that never happened and nobody can get in touch with him. Earlier in the day, the paralegal and the manager of the real estate company asked for names and contact information for the rest of the board and they guy refused to even give the names of the other folks on the board. So they asked the name of the attorney who represents the HOA in this matter....Yep, crickets again and he refused to give out the name. I mentioned to my son-in-law last night that prehaps an audit of the books are in order....hopefully he goes down that road.
The company my son in law works for has been great through this....they told him to take the time off and get this settled before coming back down to South Carolina and work.
It was this situation and the fact that my 2 year grandson was taken to the emergency room in an ambulance because an allergic reaction and couldn't breathe. His is fine now and as they say that is a different story...It has been one hell of a week so far.....

Oh, I forgot to add that the guy turned to profanity and started yelling at the paralegal during the afternoon....I wonder if they are recording these????

First things first, good to hear your grandson is good now - having allergic reactions like that aren't fun in the slightest and thankfully someone was near him to get him the help quickly.

For the HOA part, if the guy doesn't show any documentary evidence, your Son in Law and Daughter are well within their rights to tell him to go have sex with himself.
