Look, two things...

First, you cant' afford an attorney for an HOA when you're blowing all the dues on your wife's 400 dollar a day blow habit and you're financing your pedophilia trips to Thailand by shaking people down over slightly misparked cars.

Get the RE deal done.... blow the whistle on this clown and see how many pairs of $700 shoes his wife has in the closet and what kind of outstanding gambling debts this cat's got.

I'm sure you've got the by-laws sitting around somewhere, the meeting minutes are most assuredly published, see what this clown is up to.

No one, I repeast no one fires a Management company and takes on those resposibilites out of the goodness of their heart.

Well, when they say shit like, "I need the rest of your HOA dues for the year NOW." or "I need 18K for a parkign violation NOW" or "Not 18K? how about 3K?" and really with no rhyme or reason to it, that pretty much tells me he's out of Meth.

Yep. Out of the many associations that we have contracted with that were self managed before us coming on, those where the prez is the main guy collecting and reporting 99.999998% of the time have fraud issues.

I one time flat out accused a prez of stealing from his association in front of other board members, and knew I was right. His rant at me about "how dare you" and such prompted one of the other board members to stand up and tell the prez that the rest of them felt the same way as me but were too scared to say anything, that is why they voted to bring in a management company. The guy's face went white and he promptly passed out.

Last I heard he is upstate with roommate named Bubba and now loves the taste of grape jelly.

Lets let this be a little lesson (your story, not my baseless accustaions against the clown Wingate is dealing with). If you, and by that I mean anyone, belong, pay money to or are in forced membership, a member of an LLC or an investor in any company or venture that has more than 10 cents of assets or annual cash flow and does not have an annual independent audit....

You need to rethink your assocation with that organization, or do what you can to make sure that happens.

HOA's, Elks, Moose, Masonic Lodges, Churches, charities... all of them.

Thank god my HOA is small time... Also that it was a brand new development so I was there for the creation of it. Also I was smart enough not to volunteer to help or else I would be stuck on the board like the 4 that are currently stuck. But I sure as hell made sure I attended all meetings and made sure things were on the up and up.

And thankfully my audit background helped as we wanted to take the audit requirement from our bylaws out (not worth spending $500+ every year to audit a $5,000 total budget). But I made sure they put in a provision that any homeowner can request an audit and forced them to keep all receipts and give us detailed cash flows at every annual meeting.

But it also gave me an appreciation of what happens in HOAs. Thankfully we are small (25 homes) and have two common areas that need upkeep (street entrance & retention basin). So we are not like some HOAs in our area that have 100+ homes, swimming pools, playgrounds and other crazy things to have maintenance on.

At first blush, I thought you were going to call down the gods on this clown by suggesting he get McNeilled. Publications to his house, email shit, all the fun stuff.

McNeil was just a tool... this douchenozzle is at best an extortionist, and at the worst an extortionist thief criminal fraud perpetrating cocksmoker.

Question for the board and especially the attorneys on here. I just found out from my daughter that the HOA has not placed a lien on the house. Probably because he has no proof and it wouldn't hold up in court. He sent a letter to our real estate management attorney's office just detailing what happened but no proof of a certified letter, no proof of a hearing, etc.
I asked my daughter since there is no lien then why don't they just close on the house. She states that the reaestate management attorney will not close because they "can't in good conscience knowing that $ may be owned to an outside agency."
I say close on the sale of the house and what recourse does the guy have without the lien? He can't put a lien on the house after the closing because the new owners didn't cause the dispute.

Our attorney is saying to pay the guy and then countersue him after the fact to get the money back....
I think that is BS and they should just close on the sale....

What do you attorneys think????
