ABC.com is reporting another career bullet for Nifong...NC DA's want him to step down now....

This guy should just come to the fact that his career is over.....This has been a cluster f@#k from the beginning...I'm not an attorney but in my profession I have ethic guidlines to follow...I don't know how this guy keep screwing up day after day in this case...:shake: the only thing I see in his future is disbarment......

Two accused in lacrosse case invited back to Duke

RALEIGH, N.C. (AP) -- Duke University has invited two of the lacrosse players accused of sexual assault to return to school as students in good standing, a defense attorney said Wednesday.
Collin Finnerty and Reade Seligmann had been barred from attending class during the fall semester while their case made its way through court. The third player charged in the case, Dave Evans, graduated in May, the day before he was charged with raping a stripper at a team party in March.

It is soooo nice of Duke to invite them back in "good standing" since the university (in their minds) had them convicted before a trial. I guess innocent until proven guilty doesn't apply to higher education.......

I respectfully disagree on this one. Having a driver's license is a privilege also but I did not see them losing their PRIVILEGE of driving. My point is that people especially individuals in some educational systems are quick to judge people WITHOUT having all the information. The university had a chance to back some of their students but they choose to throw them under the bus instead. Political expediency and their public image was more important to them than supporting one of their own. Do not get me wrong as I am not asking them to flat out ignore the charges but the young men had every right to attend the university until they were found guilty of said charges. The university should have taken a neutral position until this ran its course, however they decided that their image was more important to them. My guess is that some (perhaps a majority) of the people on this board will feel the way you do and I can see the logic of that. All I really know this is not an easy or issue issue to answer....

I agree, wingate. When accused of a crime, the punishment and consequences should not begin until you are found guilty. I'm certain if methomps was accused of a crime and was fired because his name was in the news, he'd be singing a different tune.

My point was that it wasn't a uniquely "higher education" thing. A lot of business would probably handle things the same way

I think most people would sing a different tune about a lot of their beliefs were things to turn against them.

Duke lacrosse accuser cleared one indicted player

DURHAM, N.C. (AP) -- The accuser in the Duke lacrosse sexual assault case told prosecutors in December that one of the three players charged did not commit any sex act on her during the alleged attack, according to court papers filed Thursday by the defense.
The attacker identified as Reade Seligmann only watched, she told an investigator, the papers said. While he was repeatedly urged to take part in the alleged attack, she recalled, he said he could not participate because he was getting married.
"The accuser's most recent recollection of events demonstrates clearly that she cannot accurately recall and describe her attackers and that any identification made by her is necessarily unreliable," the defense filing said.

Prosecutor Asks State to Take Over Duke Case

DURHAM, N.C., Jan. 12 ? The district attorney has asked the state attorney general to take over prosecution of the sexual offense and kidnapping case against three Duke University lacrosse players, an official involved in the case said today.
Michael B. Nifong, the Durham district attorney, faxed the request to Jim Coman, head of the state attorney general?s special prosecution unit, today, the official said. Mr. Nifong decided he had no choice but to hand off the case because he faces a conflict of interest with ethics charges pending against him for his public comments on the case, the official said, speaking on condition of anonymity because there has yet to be an official announcement of the request.

State taking over Duke sex assault case

RALEIGH, N.C. - The state attorney general's office agreed Saturday to take over the sexual assault case against three Duke University lacrosse players at the request of the embattled district attorney.
Durham County District Attorney Mike Nifong, hamstrung by a flip-flopping witness and dogged by allegations that he made inflammatory statements to the media, asked Attorney General Roy Cooper's office Friday to appoint a special prosecutor.
"I wish I could tell you this case would be resolved quickly," Cooper said at a news conference Saturday. "Since we have not been involved in the investigation and prosecution, all of the information will be new to our office. Any case with such serious criminal charges will require careful review."

The team is back in play today for the first time since the charges last year. They will be playing with the numbers of their 2 falsely accused teammates on their jerseys and a wristband with innocent on it. The game is on ESPNU
