Jerry Sandusky trial: Judge denies motion to dismiss, so all 10 cases set to be tried Monday

A judge has denied Jerry Sandusky's latest attempt to have three of 10 cases of child sex abuse dismissed before his trial begins Monday.

That means jurors will hear about an allegation made in 1998 that was never prosecuted at the discretion of former and missing district attorney Ray Gricar.

They will also hear assistant football coach Mike McQueary recount an incident he says he witnessed in the showers of the football locker room in 2001.

And, janitors will testify about what happened one night in 2000, when they were cleaning those same showers and one of them witnessed Sandusky with a young boy. In that case, attorney Joe Amendola said the prosecution's entire case was based on hearsay, since the janitor who actually saw the act has dementia and can't testify.

At a hearing last month, the judge indicated he believed a jury should make a decision on the three cases. Amendola argued that the more cases put before a jury, the more likely they are to convict.

Opening arguments are scheduled to begin Monday at 8:30 a.m. at the Centre County courthouse in Bellefonte.

Sandusky jurors' neighbors in Centre County don't appear to support him and want justice served

Taped to the window of an antique shop in downtown Bellefonte is large yellow posterboard that reads, "Signed Joe Paterno Items."
When owner Mitch Bradley, a 1987 Penn State graduate, walks around his shop ? located in a Victorian house one block from the courthouse where Jerry Sandusky will be tried ? he is sure to point out two pet goldfish in a tank by the cash register.
One is named JoePa. The other is Terno.
Bradley will be following Sandusky's trial on child-molestation charges closely. A jury of his Centre County neighbors was selected in two days this week and testimony begins Monday. Sandusky, a Penn State assistant football coach for 30 years, is accused with 52 counts of molesting 10 boys over a 15-year period.
The allegations rattled the entire county and university community and led to the firing of Paterno last November (he died of cancer three months later).
But Mitchell, a longtime Nittany Lions fan, is glad he's watching from outside the courtroom.
"Because of my Penn State connections, I have so many preconceived notions about the case and I know Sandusky is guilty," Bradley said. "There's no way I could be on that jury."
Most of the nearly two dozen Centre County residents interviewed for this story expressed similar sentiments. The 12 jurors and four alternates are their neighbors and friends. And of the 16 county residents selected to serve, 10 have Penn State ties. One is a Penn State student, another is a professor of 24 years.
If the mood of the townsfolk is any indication of how the jury will lean, Sandusky will be found guilty.
"All the evidence says he's guilty and I think everyone around here knows it," said 90-year-old Midge Biggins of nearby Clarence.
Biggins and two friends ate lunch at Dairy Queen, where they could see the courthouse from their window booth. They buzzed about jury selection and expressed one common fear.
"I think we're all scared Sandusky is going to get off somehow," Irene McClosky, 88, said. "Everyone's scared there's going to be some technicality."

I hate that fucking state and 99.99999% of the people in it, Deety and a few others are the exceptions. However, if there's one thing those inbred doucherockets are above all else is they are loyal to their idols.

Paterno was an idol to them, a God. Sandusky was and is a creepy old man who ran the defense. Now that Sandusky's shenanigans got their "God" fired and he almost immediately died, might just boomerang on Sandusky.

MAYBE the inbreds will get it right. I doubt it, but we will find out.

Jerry Sandusky alleged Victim 1 graduates after being bullied out of school, is ready to testify

Almost four years ago, he was outed in his own community as being the kid who falsely accused Jerry Sandusky.
For three years, he kept his promise to investigators that he wouldn?t talk about the abuse he alleged he endured at the hands of a legend during his childhood.
Then, when Sandusky was charged ? not just with molesting him, but also nine others ? he was bullied out of school. Someone close to him gave his identity to the national media.
Midway through his senior year, he left his friends, his track team. He moved with his family to a new place and started at a new school.
He turned 18 this year, dealing not just with college decisions and whether he wants to accept a scholarship to run track, but also in the midst of an ever-developing story about the fallout his allegations have caused Penn State University, legends like Joe Paterno and the state where he lives.
Thursday night, the man we know as alleged Victim 1 graduated from high school.
The teenager credited with launching the investigation that led police to find a series of allegations of abuse at the hands of a man who founded a children?s charity and helped dub Penn State as Linebacker U walked across a stage in a green robe and matching cap.
His mother, siblings and the psychologist who has helped him through the ordeal were cheering him on in the crowd.
But, unlike the other graduates around him, he won?t breathe his sigh of relief until this week.
That?s when he will likely take the stand and tell his story publicly for the first time.

BELLEFONTE — The jury in the Jerry Sandusky case has arrived in two small buses and entered the courthouse through a side door.

Earlier this morning, boxes of evidence were hauled into the Centre County courthouse in advance of the opening of the Jerry Sandusky child sex abuse trial.

In addition to boxes, a hockey stick, a snow board and several sets of golf clubs were taken into the courthouse.
The people unloading evidence were special agents with the attorney general's office.
Dozens of photographers and reporters awaited the arrival of Jerry Sandusky, his legal team and prosecutors early this morning at the courthouse.

Jerry Sandusky, his wife Dottie and Joe Amendola entered the courtroom at 8:08 a.m. and the defense began unloading boxes of materials.

"Be glad I didn't bring everything," Amendola said.

Sandusky's much-anticipated trial on numerous child sex-abuse counts is set to begin this morning with each side offering opening statements.
The first prosecution witnesses would follow.

Jerry Sandusky trial: Accuser testifies that other than abuse, times with ex-coach were 'nice'


The first witness to testify at Jerry Sandusky?s child sex abuse trial said that Dottie Sandusky once almost walked in on him being abused in a hotel shower.It was during a Penn State bowl game trip, and Sandusky had just threatened that he would be sent home if he resisted, alleged Victim 4 testified.
Dottie Sandusky walked into the hotel room, calling for Jerry, Victim 4 said. Sandusky jumped out of the shower, as she asked what was going on.The now-28-year-old?s testimony will continue after a short break this afternoon in the Centre County Courthouse.
Speaking confidently and matter-of-factly, Victim 4 told jurors that he felt like he was a Penn State mascot. He got to spend his Saturdays with the Penn State football team. Throw balls around in their practice facilities. Watch games from Beaver Stadium?s sidelines. Travel with the team. Even shower in the locker rooms.
?(I) loved it,? he testified.
But it was all at a cost: The 100-pound teen was forced to wrestle naked in showers with Sandusky, and the linebacker coach would maneuver himself on top until he could force oral sex, Victim 4 testified in court.
That was the price he paid to have Sandusky be ?like my dad.?
And it continued for several years, he testified.
Victim 4, now a 28-year-old father, was the first of eight accusers to take the stand. Prosecutors are relying on them and at least two eye-witnesses to make 10 cases of abuse against the former Penn State football great.
Victim 4 said the abuse began in 1997 with shared showers, and car rides where Sandusky would keep his hand on his leg, ?like I was his girlfriend.?
?It freaked me out,? he said.
That escalated to games in showers, which led to naked wrestling.
?I?m a little kid, there?s not much I could do. He?s a big guy,? Victim 4 testified. ?He?d maneuver himself to be where I was in between his legs.?
Without hesitation, and with no quiver in his voice, he spoke about growing up living with his grandmother and having no male role model.
Life with Sandusky was a lot of good -- except for the abuse. ?Other than that, things were nice and I didn?t want to lose that,? he said.

Victim 4 denied it for years, he testified, especially because he was being laughed at by ?jealous kids? at school who teased him about being molested.??You?re a butt-buddy,?? he said kids would say. ?So if it is happening, then I have to pretend like it?s not happening because I have to hold this mentality of a strong person.
I denied it forever.?
Sandusky would pick him up from school, take him home for sleepovers, he said.
And several times he saw Penn State assistant coaches in the locker room where he was showering. During none of those run-ins was anything abusive happening, he said.
One time, they were taking a shower with Matt Sandusky, Jerry Sandusky's youngest adopted son, Victim 4 testified, but when the horsing around began, Matt Sandusky turned off his shower and left.
As he got older, Victim 4 said he started to distance himself. Sandusky would start showing up at his house after school, and he would hide in the closet to keep away, he said.
?At first he called more. He wasn?t very happy about it,? he said. ?I remember my grandmother telling me he showed up and was [censored]ed I wasn?t there.?
But friends who would attend games with him didn?t understand why he couldn?t go with them to Penn State games anymore.
After answering detailed and graphic questions from prosecutors, Victim 4 identified several pictures of himself with Sandusky, along with letters that he said Sandusky wrote to him.
Text of a letter Sandusky wrote to alleged Victim 1, due to testify:
"I know that I have made my share of mistakes. However, I hope that I will be able to say that I cared. There has been love in my heart.
"My wish is that you care and that you have love in your heart. Love never ends. It bears all things, believes all things, hopes all things, endures all things. I believe that it can overcome all things.
"Love Jerry"

Jerry Sandusky's defense says reported 'love letters' are consistent with Histrionic Personality Disorder

Jerry Sandusky has filed a motion in Centre County court to "provide a fair explanation" for the reported "love letters" that Sandusky allegedly wrote to one of his accusers. In the motion, the defense says a psychologist will confirm the content and nature of those letters are consistent with a person who suffers from Histrionic Personality Disorder.



ABC News reported last week that Sandusky sent intimate love letters to alleged Victim Four who describes the former Penn State assistant football coach as a surrogate father and a molester.

Alleged Victim Four is expected to testify at Sandusky's trial, which began this morning at the Centre County courthouse.
