Well, unless the prosecution can convince the judge later that they're going to have an impossible time selecting the jury, it's pretty much all but sure he'll walk unless there's photo/video evidence of the crimes. In that town, nothing will convict him unless it's played right in front of their eyes, and even then you'd probably have a hard time.

And I expect the locals that want to absolve Joe Pa will fry Jerry because they will blame him for what happened to Joe Pa.

Former AD Curley (officially 'on leave') wants them to throw out the perjury charges because:

A) He performed his legal and moral duties to protect children from sexual predators

B) The law at the time didn't require him to report such a crime

C) The statute of limitations has run out

D) JoePa's dead, so there aren't enough witnesses

E) Any combination of B, C, and D that lets him off the hook

Tim Curley, Penn State AD on leave, wants charges tossed

HARRISBURG, Pa. (AP) -- A Penn State administrator is asking a judge to throw out charges that he lied to the grand jury investigating child sex abuse allegations against Jerry Sandusky and that he failed to report suspected abuse.

Tim Curley filed motions in Dauphin County Court on Monday that argued the death of football coach Joe Paterno last month leaves prosecutors without a required second witness to support the perjury charge.

He says allegations he didn't report suspected abuse in 2002 were filed under a revision of the law that was passed five years later. He also says the statute of limitations has run out.
