I think Michigan should play as an independent...they can play UMass and Connecticut 3x each, since that's where Simple Jim battles for most of his great recruits.

I think there is some fantastical view of what the NCAA is and can do.
The only way he can speak to the judge is as a witness and yes, under oath. All the evidentiary rules/rules of civil procedure apply to a TRO. Anything he would say not under oath would carry no weight. I've done around 50 TRO hearings and judges will typically tell non-attorneys to shut the hell up if they are not on the stand. Their legal team is between a rock and a hard place here...on one hand, you don't want Harbaugh to testify for a variety of reasons (one being the chance of perjury as you mentioned). On the other hand, they really are in an uphill battle from an evidence standpoint and carry the very high burden of proving their case for a TRO, which would seem to be very difficult without Harbaugh's testimony. On Monday, Harbaugh said he didn’t know if he would be called to speak in front of the judge. Still, he plans to attend the hearing, where Michigan will argue that Big Ten commissioner Tony Petitti lacked the authority to suspend Harbaugh under the league's Sportsmanship Policy.
Just wonderin': If he speaks to the judge Friday, will he be "under oath"? If so, perjury would be a "whole new ballgame"......
100% this. It's like that Heisman trophy that the NCAA took back from Reggie Bush. My sincere hope is we throttle them in AA to remove all doubt, then all the wins get vacated after The Game and they are banned from any bowl game (in addition to other punishments such as loss of scholarships and Harbaugh getting shown the door). Double serving of justice in that scenario.And this is what scUM wants. It is the reason behind the "let due process play out". It has nothing to do with a new found sense of patience or proper justice. It's the team and their fans so desperately wanting a shot at a natty. Meaning, God forbid it happens, even with it vacated you'll still get the "Well, we all still saw it happen on the field and that is what counts".
The record books will show one thing, but the fans, ALL of us, will know and under it as something else.
The only way to truly punish is prevention. You can't have them getting to the conference title game or the playoffs. Given how the NCAA moves at the speed of glacier, it's really up to the Buckeyes to halt this madness in two weeks.
