They'll know. tsun will absolutely lawyer them up.There's also just providing the threat itself, and then saying you'll offer 'immunity'. Most threats the NCAA can't make good on, but most of these players probably won't know that in the moment. You may end up getting a few to start talking out of panic alone.
There's that and the immediate and irreparable harm standard is quite difficult to meet in reality. He's already sat out one game and they beat #10 PSU, what immediate harm is there even throwing aside that the evidence is not on their side? I could invent some arguments for the other side, but they would be pretty stretched.Regarding the TRO …
If there’s irreparable harm to tCun by Harbaugh not being there, that would be because he’s so valuable to the team during the game because he’s aware of everything that’s going on during a game, right?
Like why his coordinators were standing right next to Connor Stalions and calling plays and defensive formations right after Stalions saw the signs come from the other side of the field, and why the coordinators would be relying on Stalions before making their calls.
I would absolutely advise against it in the unfortunate chance I would have to represent Harbaugh. He'll keep barking to the media with inadmissible statements not subject to the penalty of perjury for now. That said, his testimony could be subpoenaed eventually, though it won't likely happen at the TRO.I'm not a lawyer; but I tend to agree. I just can't see Harbaugh's lawyer allowing him to testify under oath (earlier statement ↓ form Harbaugh's lawyer).
I would expect Harbaugh (under the advice of council) to decline any opportunity to testify under oath.
He's being paid during his suspension so there is no immediate financial loss. The president of the university and board of regents have done nothing but praise and back him from the start, so there is no stigma that attaches from his own institution. I believe the president stated his raise was still in the works, so there is no future loss. He is permitted to coach throughout the week and as part of that prepare the game plan. Hard to see where the great and immediate harm originates.Regarding the TRO …

Not to give them any credence, but I would imagine the argument would be that a loss preventing them from getting to the CFB would be irreparable and immediate. I would bet the house on that argument, and actually compelling on the surface because that is an intangible loss in one sense. If a TRO ever starts gravitating towards financial loss, the one seeking the TRO is getting concerned. He's being paid during his suspension so there is no immediate financial loss. Thought: the NCAA has no authority over the CFP. That’s an entity unto itself. Ergo they could refuse or invite Michigan regardless of what the Big Ten or the NCAA wants.
I mean he’s right. The fact there’s a mention of that and then Weiss’ computer? They bet on freaking games.
It’s a shame if they don’t release that information before the season is over.
