NCAA punishes USC - Reggie Bush, OJ Mayo, Dwayne Jarrett, Joe McKnight investigation

If in those tapes his stepfather says petey knew and or set it up for them they are fucked. Thats definately lack of institutional control. USC better get a dorm ready for the NCAA investigators because if this is proven so they are gonna camp out there.

Getting 300,000 for a player or family member by setting them up with a booster or agent and being able to prove it with audio tapes=your fucked for a long long time. If this article has substance they are gonna forfeit alot of stuff and be penalized for a longtime. I could see Auburn getting the 2004 championship...it really sucks for their players/fans because they didn't win it on the field. Your right buddy sneaky pete probably has an ace in the hole...hell maybe snoop dog can help them out:!


Or maybe nothing will happen because the violations were on the player and NOT the school......

For awhile I thought he was going to carry on an entire debate/rant by himself...
If the violations were so blatant and obvious, the NCAA would have found them in the previous year and a half of searching......
No, not really. I'm guessing you haven't followed this case very closely, re: Lake. The NCAA has very little power during their investigations, so when no one talks (whether by allegiance or financial persuasion), there's not much they can do without subpoena power.

Maybe, but given the vehemence of the accusations by b2002 here, if things were really that obvious to earn the school itself something akin to the death penalty by the NCAA, I assure you they would have found something by now.

I'm not saying what you say isn't true because it is, but SMU (for example) was so far out there in the wrong they couldn't help but find things. All of the SEC schools that were busted in the 80s and 90s were pretty far into the wrong side of things as well and the NCAA had no trouble finding things.

To some degree the issue of whether or not the staff or the program knew is moot as these accusations arose when Reggie was still there and USC did nothing about it.

If the NCAA proves it did happen USC can not claim ignorance as they were informed of these suspicions and chose not to investigate AND didn't cooperate...meaning NOW they are culpable.

Timing is everything....if this didn't get on the radar until AFTER Reggie had left then USC and the staff would likely be able to separate themselves by claiming it all happened without their knowledge....but because it was brought up and ignored...well now.....USC can't please ignorance...hell WE knew about it.

Granted it would be worse if the staff knew...but at this point the best case scenario for USC (if the accusations are true) would be that they didn't know as they occurred and then chose not to pursue them when Yahoo broke the story...the NCAA won't like that answer. Of course the alternative is the staff or the program knew and then the punishment will be MUCH worse..but either way I think USC is facing penalties.

EDIT...keep in mind this makes everything fair game too...recall that the NCAA investigated our football program with so much scrutiny that they found out several women bball players rec'd free braces...and those girls didn't even know as the dentist told them their insurance covered it. If USC and the fans think this is much ado about nothing they must also think their program is clorox clean....and I think even the cleanest programs still accidently run afoul of NCAA rules.

I believe Josh is right on this. Without someone coming to them (Lake) they have very little.
Now. If Lake has some incriminating evidence or even some important
clues, they will start a process. Just starting a process would be a very bad thing for USC. The vultures would immediately start circling.

Subpoena power is the power to compel a person or entity to do something (turn over documents, come appear for an interview, etc). The NCAA is a private association, and thus has no broad power to compel other private people or organizations to do what they say. Now, the NCAA has the power to force its member institutions to do things, but that power is derived from the consent of those organizations who elect to associate with it.

Reggie Bush, Lloyd Lake, and Yahoo! have no association with the NCAA. There is nothing the NCAA can do to compel them to cooperate.

Think of BP as the NCAA. Power-hungry mods and admins can make you comply with our rules, but that power is only derived from your interest in being here. If you choose to walk away and not associate with BP, we have no power to do make you turn over your phone records. We can threaten to ban you, but that is the limit of our power.

A subpoena is issued by the legal system to compel someone to appear to give testimony. The NCAA is not part of the legal system and doesn't have that power.

If you are an unwilling witness to a crime and the prosecutors want to know or confirm what you know, then you may likely be the subject of a subpoena.

Basically a subpoena is a a legal instrument by which the authorities may demand that you speak the truth, or suffer a penalty. In fact, that is literally what subpoena means - under penalty.

What flabbergasts those who watch the NCAA from afar is when, what is perceived as the governing body of collegiate athletics, it does not impose penalties on players, coaches, institutions and conferences who refuse to cooperate with NCAA investigations.

What these folks don't understand is that the NCAA is essentially a voluntary house of cards. Which is why the admonishment offered by this article in SI wouldn't really work.

As the investigator quoted in the article notes, most of the time they are able to get the goods they need, in time, without legal authority of a subpoena, or it's business or commercial equivalent.

Then all you have to do is send away for Tib's home study course on how to get around a ban and your right back in the game.
