The judge who will determine how much time Michael Vick spends in prison has shown little mercy through the years for high-profile defendants.
Nobody knows this better than defense lawyer Robert H. Smallenberg. In 2004, he represented a city official who stole more than $1 million from Richmond, Va., taxpayers. He was aware that U.S. District Judge Henry E. Hudson had a reputation for handing down stiff sentences.
"Tough but fair" is the description most often heard from lawyers who appear before Hudson, who owns a Bichon Frise dog and declined to be interviewed.

Vick's estranged father says QB has been fighting dogs for years

ATLANTA -- Michael Vick's father said he pushed his son to quit dogfighting years ago or, at least, put property used for the fights in the name of friends to avoid being implicated someday.
Michael Boddie, in two sometimes tearful interviews with The Atlanta Journal-Constitution this week, said some time around 2001 his son staged dogfights in the garage of the family's home in Newport News, Va. Boddie also said Vick kept fighting dogs in the family's back yard, including injured ones -- "bit up, chewed up, exhausted" -- that the father nursed back to health.
Boddie, who is estranged from his son, dismissed the idea that Vick's friends were the main instigators of the dogfighting operation. "I wish people would stop sugarcoating it," Boddie said. "This is Mike's thing. And he knows it."

The attempt to only plead guilty to some charges in interesting. He's apparently been told that if he pleads guilty to the gambling charges he could be more harshly penalized by the NFL. And he doesn't want to admit to taking part in killing the dogs for legal and PR reasons.

The prosecution has been very skilled in the way they've handled this case. I'd expect them to tell Vick's lawyers that he has to plead guilty to more than what he's offered to so far, or they'll file additional charges and/or recommend a longer sentence. But the brinksmanship on the deal opens the possibility of a trial actually happening.

So, can he resurrect his NFL career in 2009 or 2010? I can't believe Goodell would let him see the field before then.

And does the Falcons' view on him depend on their won-loss record (and attendance figures) over the next couple of years?

I imagine the Falcons will go a different direction via draft or free agency next year, because they can't wait around for Vick to come back, if he comes back, especially sitting on Joey Harrington and nothing else. If Vick plays again, I bet it will be with a different team.

I agree, Vick is the type of QB that you need to completely change your offense for. I figure the Falcons will most likely draft or trade for a QB over the off season then begin to build around them.
