Jameis Winston (QB Browns)

My big concern with this whole thing is that the Florida State Attorney is a Florida State graduate. It seems as though he was raised in Tallahassee. If that isn't a conflict of interest...

It shouldn't matter. One would hope that professional ethics and human decency might prevail. Sadly, and especially when it comes to foosball, that's not the case.

And as much as I like to teabag all that is southern, it's not confined down there as the Steubenville situation sadly demonstrated.

It's not just football. It's all celebrity. And all power.

Humanity is what it is.

Meggs mentioned the possibility of a drug and the toxicology reports a couple of times, which seemed odd. What I read into that is that he suspects that GHB might have been involved, which can be used as a date-rape drug and frequently results in memory difficulties not explained by the accuser's blood alcohol level, which he said could be "extrapolated" to have been around .10 at the time of the incident. The GHB aspect is obviously based on a fair amount of speculation on my part.

I checked the report and it did screen for GHB. If any drug was used, it was something unusual or something that left the system very quickly.. within a couple of hours. Something I missed before was that her friend called the police. The complainant had told her friend that she thought she had been hit on the head. The documents do not indicate if her friends were ever interviewed again and there appears to have been no attempt to find witnesses from the bar who might have seen her leave with Winston. From looking at the documents, it seems they (police/prosecutors) did as little as possible on this.

After reflecting on this a bit after re-reading the documents, one thing really stands out to me. She had no time to formulate a story. Not that I'm an expert on this, but the reason it's called "morning after" regret is usually people have the regret.. in the morning, the next day. From her text records, which support the timeline, everything happened within a 45 minute window, that includes both the cab ride from the bar to the apartment and Winston taking her home on his scooter. Within a few minutes after that, she texted the friend she was with earlier in the night and said she needed to talk to her the next day, and then called two other friends and told them she had been raped. One of the friends called her parents and the cops. Nothing indicates any kind of motive for a premeditated set-up job. She would have to be one devious little miscreant to come up with such a story on the spot. The only thing missing is an explanation for why she was "incoherent" during the incident. I'm not saying I have any idea what happened, but her version of events is certainly plausible.

Nobody said he DID do anything wrong either. I'm not sure how anyone can stake a claim here. Geez, there are multiple people involved and the other person wasn't charged and that other person corroborates with Winston's position.

You mean the other person whose DNA was found - her boyfriend - who doesn't corroborate Winston's story.
Or do you mean the witnesses that appear a year after the event with crafted stories, who the defense attorney essentially verified were team mates?

So the people standing in the room watching Winston have sex with this girl have more credibility than the girl? It doesn't seem like highly biased witnesses would elevate it above a "he said she said" situation. In fact, doesn't the fact that most people don't want to be watched while they are having sex make it MORE likely that it wasn't consensual?

I think generally that would be the case. And as prosecution, you would seek to impeach their statements in one way or another. But since they were given more than 6 months to corroborate their stories, and never interviewed in the immediate aftermath (in order to compare their original stories to the present), that becomes extremely difficult.
Excepting some masterful Sherlocke Holmes revelation... their testimony would stand as-is in court.

To be fair to the prosecutor, how are you going to find witnesses from a bar 11 months ago ? =/
The police botched the case from the get-go by failing to investigate and instead telling her to take a hike.

I was more referring to the cops. I mean she indicated that night she met him at the bar. There was no identification at that point. You'd think they'd try to figure out who he was. The football angle doesn't even explain that much. She didn't identify him until she saw him in her class a month later or indicate she thought/knew he was a football player or even a student for that matter. Maybe I'm naive, but black men raping white college students is usually a big deal to law enforcement and by all accounts the initial investigators took her story seriously.

BTW, the other DNA (the boyfriend's) was found on her shorts, not her underwear (where Winston's was found). I think they were just trying to rule out the potential for other suspects.

Well, nobody wins in this situation. Poor form by the authorities at the press conference today. Honestly, I don't put too much stock in the reports of Jameis' roommates/friends who were with him - I believe they're both football players and probably would lie for him/their team without hesitation. I think ultimately why the prosecutor decided to not go forward was he didn't think they could rely on the victim's testimony in court considering she didn't seem to remember a lot of things. But the question of why she didn't remember very much is the one thing that I wonder about after looking through all those documents that there isn't any real answer for.

So basically it's taken seriously up until the time that the suspect is identified. Then there's the entry about how it's a football town, they look into the phone records (which seems to corroborate a state of distress), and then it gets swept under the carpet.

Apparently her boyfriend's DNA was blood-related on her shorts.
And Winston's was saliva-based.
The initial reports say that she had several bruises
The story about his room mate interrupting them, and the 3rd male in the cab telling her to call her friend... why would you make those details up if you're lying?
The texts and calls strongly suggest something happened as well

This, and it's a shame. As we say in central/south Florida, Tallahassee = Southern Alabama.

I'm not surprised by the ending of this shit show one bit. Rape cases are tricky for a million different reasons, and this one is clearly no exception. In fact, it's even shit showier (new word?).

I feel awful for the victim. Not only was her (alleged) attacker not charged or prosecuted, she has to see his face everywhere. It honestly sounds like my worst nightmare.

"We've carefully reviewed all of the evidence in this case and have concluded Florida State has no shot at winning the national championship, er , I mean, there isn't enough evidence to charge Jameis Winston..."

There was no "victim" and no "attacker".

I understand that you have an agenda, but Jameis Winston is innocent.
