Jerry Sandusky trial: Accuser testifies about alleged sex acts that took place in Sandusky's basement

A 25-year-old Centre County man who picked up a phone in November and responded to a plea from the state Attorney General's office for men who had been abused by Jerry Sandusky to come forward and tell their stories took the stand as the third alleged victim in the child sex abuse trial. Known in a grand jury presentment as alleged Victim 10, he testified that he was a Second Mile child, in foster care in 1998 because of a bad home life, and was forced to exchange oral sex with Sandusky in the basement of his home at least five times.

"We were wrestling and the defendant pinned me to the ground, pulled my shorts down and started performing oral sex on me," he testified. "I freaked out."

At some point, the then-11-year-old told his foster mother he didn't want to go to Sandusky's house anymore.

But that wasn't until after it happened several more times, he said.

Sandusky would sometimes take him to the mall, buy him clothes and games and shoes before the assaults, he said.

Other times he would take him to events first, he said.

It ended shortly after Sandusky took him on a car ride, unzipped his pants and asked for oral sex, Victim 10 testified.

He refused.

"He got quiet and had a look on his face," Victim 10 testified.

Victim 10 is now married and expecting a child, but his life has been rough. He spent 23 months in jail for robbery and has a burglary conviction, as well.

Until he heard about the charges filed against Sandusky in November, he said he had told no one about the abuse.

"I was scared, I was ashamed, I was embarrassed," he said.

During his testimony, there was an audible sigh from spectators sitting in the rows assigned for guests of Sandusky.

Attorney Joe Amendola questioned the man about why he returned to Second Mile camps after the abuse allegedly happened.

Victim 10 said he didn't remember telling a counselor that he enjoyed camp, like Amendola alleged.

His former foster mother also took the stand this morning, testifying that Sandusky called her one day and said: " 'I'm Jerry Sandusky.' I said, 'OK.' He had known (Victim 10) from a Second Mile camp, and wanted to know if he could take him on an outing," she said.

She remembered her foster son getting gifts from the former Penn State football legend.

Former Penn State head football coach Joe Paterno had close business ties with board members of The Second Mile, the charity that his assistant, accused child molester Jerry Sandusky, allegedly used to recruit his victims, The Daily has learned.

Around the same time a graduate assistant allegedly approached Paterno in 2002 to say that he had witnessed Sandusky raping a boy in the locker room showers, Paterno and three fellow investors, including longtime Second Mile board chairman Robert Poole, had just secured financing to build a $125 million luxury retirement community, according to public records.

Paterno also was partners with this team on developing a golf resort and nearby restaurant and inn. He has also partnered with other current and former Second Mile board members on a bottled water company, a coaching website and a chain of convenience stores.

The Second Mile has said in a statement that Sandusky told the charity he was under investigation in 2008 and was immediately removed from programs involving children, although Sandusky didn?t resign until last year. In an interview with The New York Times published Saturday, Sandusky said Paterno never confronted him about the accusations.

Officials at the charity would not specify who was notified. But some have questioned whether certain people within the charity knew before 2008, given Paterno?s close business and personal relationships ? including dinners and a Bahamas vacation ? with Poole and several other past and present board members.

?I honestly think there was a conversation. I can?t believe there wasn?t one,? fumed one former board member. ?To be honest, I think people were worried about what would happen to Penn State and The Second Mile if Jerry Sandusky was found out.?

Several former Second Mile board members, who all asked to remain anonymous because of their ties to the tight-knit community in State College, told The Daily that if anyone on the board knew about the 2002 incident, it would have been Poole, who also was close to the charity?s former CEO, Jack Raykovitz.

The Second Mile?s statement said Raykovitz was told in 2002 that a student was ?uncomfortable about seeing Jerry Sandusky in the locker room with a youth? ? not that Sandusky had allegedly raped the boy.

Victims? attorney Jeffrey Fritz ? who plans to file a civil lawsuit against The Second Mile ? said he?d like to know whether Paterno personally told any other board members about the 2002 allegations.

?It?s certainly the type of thing that I?d ask about in a deposition. I?d want to know how much time they [Paterno and his business partners] spent with each other,? said Fritz.

?If you think about it from a logical standpoint, how do you have this group of people that are so intertwined with each other, and then have something like this come up, and then they not talk about it??

Pinnacle Development, one-half of the developer team that built The Village at Penn State, included Paterno, Poole, William Schreyer ? a Penn State trustee whose daughter is a longtime board member of The Second Mile ? and local developer Philip Sieg.

Each partner stood to make an estimated $590,000 in fees and 15 percent annual interest on an $125,000 initial investment if the project was successful enough to get funding for a second phase.

It wasn?t. The Village?s nonprofit owner filed for bankruptcy on Wednesday. The filing indicated that Pinnacle was never repaid its initial investment.

Poole?s companies, Poole Anderson Construction and S&A Homes, had also expected to make an additional $3 million contracting fee, much of it coming with the second phase, which at the time would have been by far the largest project his firm had built. Sieg and Schreyer both held interest in S&A Homes.

Paterno, the winningest coach in college football history, was recruited ?because his affiliation would certainly make a lot of [retired] alumni perhaps take a second look,? Sieg told a reporter at the time.

Paterno could not comment for this article because he is ?undergoing chemo and radiation every day? for lung cancer, his wife, Sue, told The Daily.

RIP Joseph Vincent Paterno, put a good word in with God for me, I know I could use it! You were a better man then I and most here. God Bless your soul.

Holy Fuck! I apologize for the late response but WTF? What exactly is a "non-emergency report of child abuse"? Dumb shit! Any form of child abuse is a damn EMERGENCY. Am I out of line in my thinking or is Ped State the Mecca of NAMBLA?

One thing to keep in mind that even the so-called voices of reason (excepting Marsh Creek) ALL leave out one name. They might condemn Sandusky to hell and throw Schultz, Curly, Spanier, the Ginger, the board, the 2nd mile board, the governor and everyone else under the bus for enabling him except one man who was the most powerful man in the university, the first one notified and was the fulcrum for the whole chain of events. None of them can bring themselves to cross that threshold and admit that JoePed was a fraud.

Seems to me to be a double-edged argument...on one hand they say that Joe was still sharp as a tack and running every aspect of the program well into his 80s who could still relate to college kids and that the figurehead stuff was pure nonsense...but when it comes to this, he was a fuddy duddy old grandpa detached from the modern world and all of its catches who never could have known anything about what his top assistant coach was doing for a period of a decade because people of his generation didn't talk about such things and he didn't have the right training (or whatever the shrink was trying to say)...seems to me it can't be both.

Jerry Sandusky trial: Defense paints Sandusky accusers as co-conspirators during alleged Victim 7 testimony



During the testimony of Victim 7 at the sexual assault trial of former Penn State assistant football coach Jerry Sandusky, prosecutors showed a picture of Sandusky surrounded by children.

Sandusky is in the middle, with his arm around Victim 4.
Victim 6 and Victim 7 are in the picture, along with several other children who Victim 7 identified for jurors.

All the kids were friendly. They all attended games together. None of them knew that any of the others were also being abused at the time.

Attorney Joe Amendola, during the cross-examination of Victim 7, spent a lot of time on the subject. Through his questioning, he made his point to jurors: He thinks some of the accusers conspired to falsely accuse Sandusky.

He pointed out that Victim 7 told grand jurors that certain things didn't happen, but then changed his story after hiring an attorney and seeking counseling.

Two of them -- Victim 7 and Victim 6 -- talked vaguely about abuse by Sandusky, Victim 7 testified under questioning by Amendola.

And, until 2009, when Victim 1 came forward and made accusations that started the investigation, many of them kept in contact with Sandusky, Amendola said. They took football tickets from him for several years, he said.

It was the first cross-examination since the trial started Monday where Amendola seemed to make some headway.

He even got Victim 7 to admit that he wrote ""Jerry Sandusky, he has changed my perceptions on life in a positive way" on an application for a scholarship from The Second Mile.

But Victim 7 was also very personable, animated and confident, made no apologies for hiring a lawyer, or seeking counseling.

He painted a picture of abuse for jurors that sounded all too familiar in the last few days.

The 27-year-old Centre County man explained a pattern of abuse that went something like this.


  • They met through the Second Mile
  • Sandusky arranged with his mother to hang out with the boy
  • Uncomfortable activity started with hands on the knee during car rides, and Victim 7 would scoot as far away as he could
  • That moved to groping of his genitals
  • During all of this time he was taking him to Penn State football games or other events every weekend, always picking him up the night before.
"I didn't want to upset Mr. Sandusky in any way, so I just did my best to get away and not make him angry," Victim 7 testified when talking about the touching he described. "Going to games was very very special to me?I want to go to these games so I'll push that part to the back of my mind."

Victim 7 is the first to testify and say that he was not forced to perform oral sex, and Sandusky did not perform oral sex on him.

The alleged abuse stopped with groping under his shorts, stomach blowing, and body rubbing, along with cuddling in bed, he testified.

Victim 7 said he took several showers with Sandusky on Penn State's campus -- where Sandusky tried to wash his body for him, and would pick him up from behind while they were both naked -- and spent several nights at the Sandusky home.

Sandusky kept a pair of mesh shorts for him to wear during these sleepovers, he said.

"To this day I'm sort of repulsed by chest hair now," he told jurors. "I just remember the feeling of it pressed up against my back and looking at it."

Victim 7 said he would stop the groping by rolling over and saying he wanted to sleep.

In the showers, Victim 7 said he would slide away or deny the help when Sandusky tried to wash his body or help him dry off.

"What would your son have had to tell you that night for you to call 911," Rominger asked.

"Crying, screaming, someone injured, I don't know," John McQueary testified. "That sounds like a 'what if.' Whatever had taken place was over by the time he saw me. It's not like I walked in on it."
Well, someone walked in on it. Guess the lack of screaming was the line drawn, then.

This is all so horrible, it sounds less like a series of moral failings and more like something that should involve exorcisms.
