The Ohio minimum wage for tipped employees is $3.43 and the federal is still $2.13.

Ok, fair enough but it also says that if the tipped employees tips do not make up the minimum, the employer is still required to pay the difference so the tipped employee STILL gets a minimum of 5.85/hr, regardless.

f the employee?s tips combined with the employer?s direct wages of at least $2.13 per hour do not equal the federal minimum hourly wage, the employer must make up the difference.

Yeah, same here in California except the state min. is $7.50. Not that living in most of SoCal is possible on your own on that......hello, 16 roomates! :biggrin:

tips are calculated based on the customers bill, not the actual tip given with the exception of credit cards. with credit there is a paper record and in those cases the tip is actually used rather than a % of the bill. if i go to olive garden and order 20 million in food then stiff the waitress not only is she getting 2.13 an hour, but she is also going to pay taxes on a tip for 20 mill in food even though she got no tip. unless i paid with a credit card.

assuming i was her only customer, not only would she receive no tip. but she likely would end up oweing her employer money at the end of the pay period because of the taxes that would be owed on my mythical tip. so instead of getting a check, she would receive a bill.

I'm very sorry the government taxes their tips, that's fucked up. That ain't my fault. It would seem to me that waitresses are one of the many groups the government fucks in the ass on a regular basis. Look, if you ask me to sign something that says the government shouldn't do that, I'll sign it, put it to a vote, I'll vote for it, but what I won't do is play ball. And as for this non-college bullshit I got two words for that: learn to fuckin' type, 'cause if you're expecting me to help out with the rent you're in for a big fuckin' surprise.
