Bucknuts and Scout Part ways

Does not sound like there is going to be a trial at all. Bill alluded to the fact that they are going to re-name the Sout BN to another name. They got all the people back and kept all of the client lists, who cares what they call it (except for S&G News...)

I feel bad for Duane personally.

The complaint has been amended and there is a request for "a jury trial on all claims triable to a jury."

Highly doubtful. Sounds like a lot of money might be owed to Bucknuts. I don't think they have taken it this far just to retain rights to the site name. That is a given. This appears much deeper after reading the document.

for the 5 people a day that asked who he was it was probably a big deal. The fact that no one ever mentioned it on the site and he seemed to not want it known I would say it probably didn't make him very happy.

If you have more Vcash I would make you a bet on that one. SCOUT would tie them into knots and it would cost them more for legal fees than is owed.

Make no mistake - this will not be won in the courts - this game is over already. IMO - Bucknuts seriously underestimated the resolve and capital reserves of the new enemy they made. It appears to me that Scout wants to make an example of them, and the capture of Nevada, Kyle, and Bill by simply throwing money at them confirms this. I know that Kyle and Nevada were 2/3rds of the reason I went over there, if Scout somehow got Duane (don't know if he has an equity stake or not), then that would be a clean sweap. Gary and others were ok, but for the most part virgin info was given by Kyle, Nevada, and Duane only.

Bucknuts failed to realize that this is an EXTREMELY low barriers to entry business. As I said above, the only real value added components to their business model was the contribution of three people. With that little leverage, to think that you are going to get away with pissing off a organization that has over 100 times your capital reserves is short sighted to say the least. Whether it be for insiders or in the courts, Scout could spend Bucknuts into the poorhouse in no time, and it seems that they are doing just that. We were not talking a complex business with huge barriers to entry and enourmous patent protection. We are talking a website with cash flow predicated on the postings of three guys - and if my hunch is right - three guys who were not all that highly compensated in the first place. How someone couldn't realize their entire tiny value added component couldnt be bought off by much deeper pockets in a heartbeat competely escapes me. Truly one of the bigger business blunders Ive seen in some time.

Interesting. We'll have to look back on this and see if you were correct, partially correct, dead wrong, or just floating air biscuits. I really have no idea what will happen, but on first glance it appears to me that Scout underestimated Bucknuts. And yes, Fox has a lot of money, but Scout will only be allowed to use so much of it. Mr. Bucknuts is probably a rich guy and Bucknuts fired the first shots, they think they can win. Scout is not going to want a long trial because it makes them look bad with all the documents now public -- everyone in the Scout network is reading those court docs saying, "Hey, they are screwing us too. Go Bucknuts! Scout, you better step it up or we'll leave you and sue you too."

Never providing proof of the advertising dollars and other revenues? Looks like Bucknuts has a solid case and Scout handled their books like a Mickey Mouse operation -- that is not going to look good to a judge and/or jury, especially not ones from Ohio. But it will be interesting to see Scout's countercomplaint because we've only heard one side of the story so far.
