tOSU trademark issues with BP

This is complete bullshit. OSU cannot fathom the possibility that someone else may make money (keep in mind, only for the new server) and they cannot get their greasy palms on any of it.

I say fuck em, they get enough from all of us over the span of a year that they can afford to allow a few shirts to be sold to spread the Buckeye cause. In a way, this site benefits OSU greatly, it unites fans.

While I share the sentiment of many disgruntled users here, realize that they do have a right to protect their interests and trademarks here. So in theory I think they're doing the right thing here, and I think this is merely the result of very limited research (you have to be registered just to browse BP and I bet they didn't even do that before emailing us). I do not have a problem with them attacking us if we are indeed a website/organization looking to mooch off of their profits. Once the inconsistencies get cleared up, hopefully everything will be back to normal.

Anyway let's just sit back and see what happens. We're putting the t-shirt project on the back burner but its not necessarily going away. The unofficial feeling I'm getting from most knowledgeable posters on this is that there is a good chance the t-shirts could still survive (perhaps with less or no on site selling), and an extremly good chance BP won't be fazed at all by this.

Alan is letting Clarity handle the situation and will not be utilizing any of his resources until told to do so. Props to him for having the resources to help, but especially for having the restaint to wait upon Clarity's direction.

The lawyer involved is a reasonable and friendly guy, I think a lot of this is a misunderstanding about what BP.com is, and what it's not. I can't yet say that the whole thing has been put to bed, but I can say that we'll be working in good faith with both Jones Day and tOSU to address any reasonable concerns they may have.

I have no intention or interest in changing the domain name. As is, we don't incorporate any of their property in our masthead or main areas of the site. The buckeyes and leaves may have to go on the graphic, but a few of you here have put together a great alternative logo, which may well be closer to something they'd be happy about anyway.

Long story short, no reasons to be concerned. Certainly, as I said before, BP as an institution can't sell tees. It's not something the site itself can sanction, and certainly can't profit from. It goes without saying that I have no problem with you all making tees for yourselves that mention or represent BP in any form you desire, but selling them from a stand on campus certainly couldn't happen.

Anyway, going to crawl back in my hole now until the next legal document arrives. Someone let Hels know he's up to bat.

Bingo. Nobody can stop you from giving Clarity money, and the T-shirts as they are currently designed incorporate no OSU logo or property whatsoever. So, yes, it is perfectly cool to sell the t-shirts (off OSU property) and give the proceeds to C-Dog.

I think it came down this:
- They hear from us that we are seeking a license for a t-shirt (red flag, why would they ask? most people aren't this polite)
- We were trying to secure permission to sell the t-shirt on campus (which is illegal)
- They can't access BP without registering, so they make assumptions about what they don't see

I think that is my interpretation of all of this. From the beginning I was not upset with the reasons behind what they were doing, rather the approach they took in communicating it. I have no problems with tOSU looking out for themselves and then backing down later once they're sure we're not stealing anything. But getting blindsided by an email like that with a fairly positive exchange with them before was what seemed off.

I'm still very curious to know what changed from when Scarlet and I were calling them asking for permission for a license for the shirt and permission to sell it (and we never acted like we were gonna do it anyway to spite them)... and the email we received. Something happened to sway their opinion, cuz they had no reason to think that we were a thriving business selling t-shirts. Also, this law firm sounds a little too intelligent to blindly throw cybersquatting and other unfounded charges at us. Perhaps they were just trying to intimidate us, but it seemed like they thought they knew a lot of things from some source of info (which wasn't looking at BP or they would have not said a lot of things).

However I'm content just having this all pass us by. Thanks to everyone that chipped in and put in their two cents. We seemed to have emerged stronger for this, if only because all of us newer members were shown why Clarity owns this site in every way. Much more than his financial contribution and vision in starting this site is his unbelievable ability to post "great post" award-level stuff constantly. Add in the rest of the mods that helped to keep everything cool, the helpfulness of Alan as an insider, and all of the legal advice from experts/commoners in this thread, and this truly is a remarkeable place.

Until I hear otherwise, I think the t-shirt thing is back up and running. It does not seem like we'll have a booth, but as of now I'm running an t-shirt project independent of BP that happens to have the upcoming site logo on it (we may have to remove the website address, not a big deal). I'm not ordering stuff for a while yet, so we still might hear that we must wait on the t-shirts. But for now, continue to PM me with your orders for t-shirts and we'll get ready for when we are cleared to move forward.

Hels is a miserable pissant who looks like he was kicked in the face by a mule.....he was fired from bsb and now acts like an inept dumbass with clay hall. Here's a novel thought....public speaking courses...And, he runs bnuts.

Oh yeah, he is also intimidated as hell by what this "free" site has been able to do during the recruiting run in january and february. His "premium" site has been beaten again and again by our information (HH, Nevada and all of us) and now he is resorting to slime tactics that are his specialty.

Hels....this comes from me.. fuck you...you and your entire team cant hold my jock....go to hell...

oh...and thanks for "trying" to steal my info for so long.....

While we're on the topic of BN, all of my graphic work that I've posted is not to appear anywhere but here or on my website (such a notice is posted on all of my artwork posts). I will also strongly encourage some of our new designers at BP (LRABuck, BuckeyePride85) among others to do the same. Enforcing this rule will not only ensure that the content is BP exclusive stuff, but it will also help to keep tabs on it so that I don't violate Jim Davidson's trust at all (he's been extremely cool about letting me have free range as long as I don't profit from it or distribute prints of amateur players).

The graphics available on this site cannot be found elsewhere. And the best part is, I'm fairly convinced some of our new guys can create better wallpapers than I have posted (one wallpaper by them that will be uploaded in the distant future is truly outstanding). In the future we may have a full fledged picture forum (possibly after we get the new server) for archiving artwork, farks, game photos, recruit photos and the like.

So if Hels is worried now, give some of us obsessed graphic types another half year and see how he feels :)

I'm thinking that Clarity's statement "Tell Hels he's up to bat." might have something to do with your confusion BFS. How should I say this? It wouldn't be the first time he's tried to meddle in the affairs of BuckeyePlanet.

Kudos to you guys that were trying to do the right thing and got a slap on the wrists for it. It wasn't warranted, but that's what happens sometimes. In the final anaysis, I'm VERY proud! As with everything we do at BuckeyePlanet, we will always attempt to do things the RIGHT way. It didn't work out this time, but we tried to do it correctly. That is a pride some of the other folks on other sites will (seemingly) never know.

im with 3yardsandacloud, i think you guys definitely did things the right way. my hats off to you guys. gost8, buckeyefromscum, clarity, and all the mods. this really is a very well run site with some kick ass members.
