09/09/09 DEMAND NOTICE INTENTION TO CLAIM ALIBI A

The defense is giving notice of its intention to use alibi as a defense. The FL criminal rules require the defense to give notice of this intention to the state. The state is required to notify the defense of its intention to call rebuttal witnesses to the alibi defense. Each side must then exchange names and addresses of all witnesses that may be called to testify about alibi. God only knows what the alibi is.

09/22/09 NOTICE OF PRE-TRIAL - 101209 COURTROOM: C AT 08:30 A

A pretrial hearing is set for 10/12/09. We will probably see a trial date set at this hearing. Defense counsel will be viewing the FL hospital medical records tomorrow. Defense will attempt to establish that the injury resulting from the sucker punch was not serious in order to reduce the charges from a felony to a misdemeanor. Defense counsel never requested to look at the medical records from Columbus. In any event Decker will need to produce some doctor top testify that either the injury was not serious or the injury was not a proximate result of the sucker punch. Good luck with that.

right now the talk is just about getting back into shape and being able to hit the weight room again. To this point he has passed every obstacle with flying colors.

OSU linebacker Tyler Moeller is cautiously optimistic about his ability to come back from his serious head injury he suffered last July when he was punched in a Florida bar/restaurant. He had surgery on his skull and has only recently been cleared to begin working out. The big test will be how his brain responds to heavy workouts and eventually, to contact. Moeller told me that his membranes are damaged, and if physical exertion ever causes more bleeding on his brain (which is what sent him to the hospital several days after the incident), then his football career is over.
So essentially, he's hopeful, but the first time he has any bleeding, he's done. To me, it's very much up in the air whether he plays again. He has one more year of eligibility.
He would not talk about the incident, understandably, because the case against his alleged assailant, Ralph Gray Decker, is still winding its way through the Florida legal system.

The more time that passes since the incident I don't know if I want to break down and cry or go to Florida and beat the living hell out of Gay Decker with a baseball bat. :mad1:

Ohio State football: Moeller optimistic he'll play this year

Tyler Moeller couldn't talk, and he was scared.

The Ohio State player was at a team function a few days before 2009 preseason camp was set to open when his right side and right arm went numb. He tried to speak, but no words came out.

"Twenty minutes later, (the symptoms) were all gone," Moeller said. "So me, being a hardhead, (thought), 'Oh, this is fine, whatever.' "

He wasn't fine. The next day, Aug. 8, he was in the hospital getting two holes drilled into his skull. It cost him his junior season and has put his football future in jeopardy.

More than five months later, Moeller and his family are cautiously optimistic that the senior linebacker will play for the Buckeyes this fall. But given the severity of his injury, no one knows for sure.

"There's no guarantees, but he's on the right track," defensive coordinator Jim Heacock said.

Moeller's saga began July 26, when he and his family were in Florida to celebrate his grandparents' 50th wedding anniversary. Along with his sister and uncle, he went out to Gator's Cafe & Saloon in Treasure Island, Fla.

There, he had a confrontation with Ralph Gray Decker, which ended with Decker punching Moeller, who was knocked unconscious and hit his head on the floor when he fell.

Decker has been charged with felony battery, and the case is slowly working its way through the courts. Decker has a pretrial hearing scheduled today in Pinellas (Fla.) County Court.

"I can't really talk about it because of the pending trial," Moeller said. "It's very unfortunate that it had to happen, that's all I can say."

Case against alleged Moeller assailant drags on

The case against Ralph Gray Decker, charged with punching OSU linebacker Tyler Moeller last July, has once again been continued in a Florida court. Moeller fell and hit his head, causing bleeding on the brain and forcing him to miss the 2009 season.

Decker is charged with felony battery. Since pleading not guilty in August, there have been four pre-trial hearings scheduled in Pinellas (Fla.) County Court.

All four have been continued. Yesterday, the next hearing was set for February 1.

If convicted, Decker faces up to five years in prison and a $5,000 fine.
