I had a trial where my guy was in an accident right after leaving a bar where he had crawfish and 3 beers, and had a blood alcohol content over the legal limit. I argued successfully to the jury that the three hour hospital delay in getting a blood sample rendered it an unreliable, and therefore useless test, as the number alone could not tell what his BAC was at the moment of the crash without first establishing when he began to drink and when he stopped.
IOW, he could have been under legal limits when the crash occurred, and then absorbed the alcohol over the next three hours.
Luckily, the opposing counsel did not bother to look up anything on the subject, and so after their toxicologist agreed with me that he could not say what the level was at the time of the crash, there was no follow up after my cross.
'Course, if my opponent had done any research, she would have known that three beers could never have gotten him to where he wound up.
