Read it again, Froh. The guy in the Sept. case, refused to press charges. The October case pressed charges and filed the suit.

I'm failing to see the reason a guy can't or shouldn't be sued because he's
a college football player.

Maybe because he is a Buckeye fan and wants to be reimbursed for his medical bills, but doesn't want to get Berry kicked off the team?

That final portion of the news story was written a little awkwardly, but I think it was referring to the alleged victim in the September incident who chose not to press charges. It wasn't describing the recent incident there. The recent alleged victim is pressing charges (I assume) and suing.
