Notre Dame QB Tommy Rees Jailed

SOUTH BEND, Ind. -- Notre Dame quarterback Tommy Rees has been arrested and jailed on a preliminary felony charge following a confrontation with officers early Thursday, police said.

Rees, 19, was arrested on charges of resisting law enforcement, battery to law enforcement, minor consumption and public intoxication, St. Joseph County Police Sgt. Bill Redman said.

According to Captain Phil Trent with South Bend police, officers were called to the house on a complaint of a noisy party. Officers saw five people jumping a fence to run away and they chased them down, catching Notre Dame quarterback Tommy Rees and linebacker Carlo Calabrese in the middle of Notre Dame Avenue.

I'd love to know what the alleged probable cause in chasing down and tackling a citizen. "Suspicion of being at a loud party?"

While it is not advisable to run when the cops are around, just doing it is not breaking any law.

I hope somebody yelled "See Terry v Ohio" as they were running :paranoid:

I would assume a loud party violates some sort of noise ordinance. Also, it is not unlikely that the police hollered for them to stop. Failure to obey a police order is problematic.

Not that police don't sometimes abuse their power, but I have always been one for putting the handcuffs on folks who violate the law more so than on the police who must apprehend them.

The cops were responding to a noise complaint, and Rees was breaking the law by drinking as a 19-year old.

He then ran away, and reportedly kneed the cop in the chest, knocking the wind out of him, resulting in them both falling to the ground. And you call that "tackling a citizen"?

I doubt the felony charge will stick (expecting that he'll plead guilty to public intoxication and resisting arrest to avoid the felony), but I don't see any inappropriate behavior by the cops, based on what's been reported to this point.

Of course, if there is no other viable QB starter for this fall (perhaps a guy with more 'escapabillty'?), Rees may want to take his chances with a South Bend jury. :wink2:
