Lake Scheduled to Meet With NCAA Today ....

Bush accuser, NCAA to meet about case
News Tribune news services
Published: November 6th, 2007 01:00 AM

The meeting is scheduled for today, a would-be San Diego sports marketer sitting down with NCAA investigators to discuss allegations that he supplied Reggie Bush with cash and gifts while the star tailback was still in college. Lloyd Lake, part of a fledgling agency that was designed around Bush as its first client, has filed a civil lawsuit alleging that he and a former business partner gave more than $291,600 in payments, lodging and other accommodations to Bush and his family from November 2004 to January 2006.

The meeting was already postponed from Friday ... leading 'SC bloggers to opine that Lake was playing for time, and was light in the legal shorts.

Lloyd Lake postponed his meeting with NCAA on Friday until Wednesday of next week, think he is looking to settle? I do. But I also think he is exposed, so he is playing some gamesmanship. We have heard a lot of talk about taped conversations and documentation of this whole mess but yet none of it has ever seen the light of day.
The assertion of a Wednesday meeting is in error - unless that is it becomes prophetic when Lake backs away from today's meeting with the NCAA.

An adverse impact does not have to be monetary

What part of it do you disagree with? You can't overcome a presumption by simply asking "How?" Otherwise, what is the point of the presumption?

Ok, let's back up. The statute requires adverse impact. On that, we can all agree. The act says that you can presume an adverse impact if the player is disqualified or suffers financial harm. Now, that doesn't mean that the only possible adverse impact is disqualification or financial harm. A plaintiff can show adverse affect even without the help of the presumption. Now, would you say that being stripped of the Heisman is an adverse affect? I hope this question seems rather rhetorical.

you can't see the forest for the trees. did someone hold a gun to Reggie's head and FORCE him to take $280,000 in extra benefits? of course not. he created HIS OWN adverse effect when he broke the fucking rules. stop trying to redirect the blame. sure, Lake is to blame as well, but his culpability does not annul Reggie's. it's like those fat girls trying to sue McDonalds.

Who is talking about redirecting the blame?

The CA legislature is well aware that nobody is ever forced to take extra benefits. That didn't stop them from creating this law. "But Reggie took the money" is not going to be a successful defense for Lake.

only in California... it's like those fat girls suing McDonalds...

but let me ask you this: is it civil or legal legislation? if it's legal, then he doesn't have a defense, if it's civil, then what jury in their right minds would award a monetary verdict to someone who had already been paid nearly $300,000 by the defendant?

Civil, and USC can sue him, too.
