As much as we would think there was a Darwin's Law of Bicycling, there isn't, so when someone on a bike does something stupid, a jury will still see a 2 ton piece of steel hitting a person on a flimsy bit of plastic. Maybe that's the way it should be viewed. Certainly a person on a bike is extremely vulnerable and there should be a scale for that.But there are laws regarding how you are allowed to operate your bicycle on the road, including Canada's very specific guidelines for lights and reflectors when riding at night.
As a bicyclist who has been spit on, had objects thrown at, had dogs and kids encouraged to hang out of vehicles and scare and harass bicyclists, I view car traffic as the enemy who can hurt me badly at any time. I am alert but not antagonistic. I obey the law because it's in my interest of survival. Everyone has a cell phone now so if someone in a car does something dangerous I will report them.
