Colorado Man Could Sue Divers Who Saved Him From Submerged Car

A Colorado man, despite acknowledging that he's lucky to be alive after being trapped in a submerged car, has filed an intent to sue his rescuers for half a million dollars.

Roy Ortiz filed his intent to sue the county of Boulder and his rescuers for a tentative $500,000 as a "preservative" measure, his attorney, Ed Ferszt, told ABCNews.com.

Ferszt said the county should have closed the road during floods in September. He said the first responders were also included because they did not realize Ortiz was trapped in the car until they prepared to lift it out of the water.

There will be no hope for this country or it's people. Not even to be offensive, he's not even of our people. How does he retain the legal right to remain in this country while pending a suit?

Next time you sit down to a hamburger at McDonald's and you feel you've been unfairly wronged because there were not enough napkins with the order, do what a California man did.

File a $1.5 million lawsuit.

In the latest example of stupid lawsuits -- and there are more than a few out there -- Webster Lucas is suing McDonald's because he didn't get enough napkins with his meal.

I'm not making this up. How could you make this up?

According to multiple media reports, on Jan. 29, Lucas ordered a Quarter Pounder Deluxe meal. He had single napkin and went to the counter to ask for more. He claims he was snubbed by the manager with a "racial slur."

In the lawsuit, Lucas claims the manager mumbled "you people" during an argument. The manager is Mexican-American and Lucas is African-American.

It must have been awful. Since then, Lucas claims he has missed work becasue of "undue mental anguish." In addition, he claims he was insulted by the offer of a free hamburger since he was apparently traumatized by just one napkin with his meal.

According to TMZ, Lucas subsequently emailed the general manager to complain -- insisting he couldn't work because of the "undue mental anguish" he was suffering as a result of the napkin debacle -- and says he was insultingly offered free burgers in return.

Lucas wants to super size instead -- $1.5 million.

Showing up here at 8:00 causes me "undue mental anguish".
When my one-year-old wakes up at 2:30am, it causes me "undue mental anguish".
Some of my customers inherently cause me "undue mental anguish".

First, "you people" may be referring to all customers. Maybe not. If I'm on a jury, though, you'll need to prove that he was referring to your race.
Second, if you don't like your experience at a restaurant, don't go back. Sheesh. What's next? We sue the TV station because it isn't showing us the program we want to watch? No! We turn to another station.
Third, I've never been to a McDonald's where the napkins were hidden away.
Fourth, use your sleeve - that's what it's for.

Driver that struck Alcona teen suing dead boy's family
Still in the throes of agony after an SUV struck and killed their bike-riding son, the parents of young Brandon Majewski are now reeling after they learned the driver is suing their dead child.

“I feel like someone kicked me in the stomach — I’m over the edge,” the dead boy’s father Derek Majewski said.

Brandon, a spunky and handsome 17-year-old bike enthusiast, was out with two buddies at around 1:30 a.m. on Oct. 28, 2012, when they hopped on their bicycles to go for hotdogs.

Not long after, an SUV crashed into the boys on Innisfil Beach Road, killing Brandon and badly injuring his friend Richard McLean, 16, who suffered a broken pelvis and other serious injuries. His other pal Jake Roberts, 16, received only scratches.

Now the driver of the SUV - a former Innisfil resident - Sharlene Simon, 42, a mother of three, is suing the dead boy for the emotional trauma she says the crash has caused her. She’s also suing the two other boys, as well as the dead boy’s parents, and even his brother, who has since died. She’s also suing the County of Simcoe for failing to maintain the road.

Even the family’s lawyer is in shock.

“In all of my years as a lawyer, I have never seen anyone ever sue a child that they killed,” Brian Cameron said. “It’s beyond the pale.”

Brandon’s mother, Venetta Mlynczyk, said she’s devastated.

“She killed my child and now she wants to profit from it? She says she’s in pain? Tell her to look inside my head and she will see pain, she will see panic, she will see nightmares.”

She was speeding, the cops didn't go through the procedures of doing a breathalyzer and she sued a dead brother of the kid. Fuck her. She should be in jail.
The kids were riding horizontally across a road at 1:30 AM, they weren't wearing helmets, their bikes didn't have lights or reflectors, and their clothing was dark. Filing a counter suit that gives you an irrational rage boner isn't grounds for putting someone in a cage.

So speeding on a wet, darkened road means everyone is free to do as they please and screw anyone else? Must be nice.

I assume you'll be turning yourself in next time you go 55 in a 50. That extra 5 mph could be the difference between killing someone playing in traffic and saving a life.

If I hit and kill someone you better believe I won't leave the scene until at least the cops take a statement from me or give me a breathalyzer. You can also bet on me being the one calling 9-1-1 to get some help to the scene and not some bystander.

Like I said, must be nice.

They gave her a roadside sobriety test. You're still ignoring the half of the accident that involved cyclists being stupid. Or can people do dumb and dangerous shit and not expect consequences anymore? Must be nice.

I don't know this person. I do know she wasn't found to have violated any laws. As far as the lawsuit goes, the family is suing her for $900k, her name is out there, and they've got internet justice warriors like yourself thinking she was speeding/drunk/texting. You could tell me you'd sit on your ass while having a potentially crippling civil suit thrown at you and being publicly slandered all you want, but you'd be lying.
