For the guys that say "no way and never have" I am guessing that you are under 35. Back in the day, prior to MADD and Nancy Reagan and "just say no", it was assumed that you got shit faced and drove. Doesn't make it right or wrong, it just was the way back then.


Folanator is correct, back in the day early 80's and back DUI used to be a misdemeanor, slap on the wrist and you were on your way. Not that this makes it correct, just how it was. Hell, I bought my first 12 pk when I was 12, rode off on my BMX with it on the handle bars (M&S carryout on Georgesville), road all the way back to Holton park (down near Valleyview) never stopped once. Things were different then.

It's still a misdemeanor, unless you have 5 priors in the past 20 years. The penalties are obviously much different.

First-time offender: Mandatory 3-day jail sentence, usually served in a 72-hour driver's intervention program - 6 days if there is a BAC reading over .17.

Second-time offender: Mandatory 10-day jail sentence - 20 days if there is a refusal or a reading over .17.



Surely, I shouldn't need to go into any further penalties with you guys right? Although I must admit I've represented a guy on his 8th before - which could get you up to 5 years in prison.

I have not drove drunk.

But, I have drove when completely exhausted from too much work.
That is just as bad.

Driving under the influence of alcohol is the most important cause of death in automobile accidents -- followed by driver fatigue. The percentage of traffic fatalities attributed to alcohol dropped from 57.2% in 1982 to 45% in 1992. The figure is probably much higher, because amounts of alcohol below the legal level of intoxication (all amounts of alcohol) reduce cognitive & physical function. More than a third of pedestrians killed by a motor vehicle fatalities in 1992 were intoxicated.

I have - one time. I was 18 and drunk out of my mind going home from a party. It was about 3 am and I was alone driving down a town main drag. A cop came the other way, did a U turn and got behind me. He drove behind me for about 2 miles before turning off. To this day - I do not know why he did not pull me over, but he didn't. That was the first and last time.
