Duke lax and accusations

I'm a little surprised that the judge hasn't put a gag order on the defense attorneys.

And Nifong's actions as a prosecutor, at least up until his primary election date, were also very questionable.

Their efforts to try this case in the public view, rather than in the courtroom, has me about to gag.

This case is a circus. I just hope the truth (whatever it may be) prevails in the end.

Didn't DNA clear every single member of the team? If so, then why in the fuck are three guys charged? How about the chick saying the newly-charged guy was one of them "with 90% certainty" and "100% certainty if he had a mustache" when the kid supposedly has never had a mustache? I guess all young white boys look alike... :roll1:

This is why attorneys try cases in the media. Because people will go ahead and come to conclusions without any evidence having been presented in a court of law.

Way to prove the unethical prosecutor and defense attorneys right Mili. You know nothing about the case except what you've heard in the media and you're ready to call this woman a "hoe". Some people are ready to call these three guys rapists. And that, Mili, is stupid.

I sure hope the truth comes out in court. (whichever way). That way I can laugh at the idiots that put their foot in their mouth well ahead of time.

So, anyone who draws any conclussions based on what is presented is stupid, huh? The media is making the stuff up about DNA tests or the "victim's" lineup comments?

Granted, the more that is brought out into the media before trial, the more of a clusterfuck this will become, but still I have a news flash for ya: Not everything presented in court is 100% accurate either. I suppose you think OJ is indeed innocent, too...

I get the feeling the defense attorneys are making a nuanced claim "no conclusive dna match" with the hope/knowledge that the soundbite culture will shrink it down to "no dna match".

It is possible he had a fake mustache. I'm not saying he did, but the statement doesn't necessarily discredit her.

The DNA evidence has not shown a direct link to Finnerty or Seligmann.
Being inconclusive, neither has it eliminated the recently charged Evans from consideration.

This part I found interesting from a trial strategy stand-point.

In addition to the polygraph test, evidence submitted in Evans' defense will include photographs and testimony from "scores and scores of people."
"We will provide evidence from credible people, many credible people, that will show where David Evans was each and every minute of that evening," Cheshire said. "None of the allegations match up to the facts or the truth."

Aside from any issues about the guilt or innocence of Evans, in his shoes I would find this strategy somewhat alarming, indeed perhaps self-defeating. Imagine, the case is moved from Durham (which is a very likely upshot of both the prosecution and defence drilling their points in front of the media). It opens in a small "uncontaminated" North Carolina country town, perhaps a quaint County Seat.

Can you imagine the jurors staying awake through, let alone maintaining an unbiased opinion of the accused, while their advocates parade scores and scores of witnesses, and undertake the inevitable, seemingly endless, testimony and cross-examination entailed. Nailing down each and every minute of Evan's moves that night - and nailing the jurors mind shut in so doing. These kids already have one knock against them, being seen as privileged sons of well-off Northerners. Do they think it wise to allow their lawyers to poison the jury as well as the public mind?

This sounds like a real fucked up situation. But this is inappropriate:

He's not supposed to make his case to the public and the media, especially where a potential jury pool could be tainted. These are arguments he couldn't even fucking make in court. This District Attorney should be reprimanded and taken off the case.

I believe this was my quote on page 2 of this thread and I continue to stand by it, just as I stand by my position that the defense is acting inappropriately.

I never said the media was making stuff up. But it's naive to assume that what you are hearing in the media will stand up in a court of law, or that you are hearing enough to draw definitive conclusions about what took place that evening.

And actually, based upon what was presented in a court of law in both the criminal and civil cases, I do believe OJ was guilty. But again, I'm basing that on what was presented in a court of law, not what was in the media.

But you are right about one thing. It is a clusterfuck. And the prosecutor has only himself to blame for that - because he's the first one to take the case to the media.

That could very well be true. I'm not saying it is, but again, this is what trials are for.

And if the kid indeed said that "he wanted to invite more dancers to his dorm room, kill them and skin them" and was serious about it, then my quote about him getting fucked up in jail stands...however, that was on page 2 which was well before other stuff came out (and almost three weeks ago), and only applies if he indeed said and meant it (and as we have all seen, we need to take a lot of "claims" with a truck-load of salt).

funny how now everyone is charging the defense of trying the case in the public. not to long ago the prosecuter was having what could only be seen as political rallies at the accusers college.

I think everyone here has been criticizing both the defense and the prosecution:

Yeah, but they and their lawyers have also done one hell of a job attempting to taint the jury pool. Lie detector tests mean nothing and allegedly cooperating with the police during a search means nothing. I think the only thing I believe right now is that everyone involved has serious credibility issues while the DA and defense attorneys would prefer to try the case in the news like a bunch of scumbags

my comments were aimed at some of the media coverage ive seen not at posters here. as usual this group has done a good job of disecting the situation and giving good input, info, thoughts, but doing so in a manner which is respectful and insightful.

I'm shocked that they actually trotted a defendant out to face the media. He was sniveling, pompous, and not well-spoken. PR nightmare.

Interesting. I thought exactly the opposite and all the talking heads I heard comment thought that the kid came off well spoken and honest.

Amazing how the filters we view life through effect our perception of the same event.

boy i dont know. for a 21/22 year old person in that situation he did a very good job i thought of comming across as normal and good kid next door.
but how many times have i said it
each mans perception is each mans reality
