Sandusky thought he was in the State Penn Showers not the Penn State Showers.

HARRISBURG, Pa. (AP) ? The Pennsylvania law requiring some school officials and others to report suspected child abuse does not apply to a Penn State administrator who's accused of keeping quiet about allegations that a former football coach molested a boy in a shower, the administrator's attorney said Sunday.
The comments by Pittsburgh lawyer Thomas J. Farrell offer a preview of the defense he plans to use on the charge of failing to report faced by his client, Gary C. Schultz, the university's senior vice president for finance and business. Farrell said he will seek to have the charge dismissed.
The charge is part of a broader case centered on retired Penn State defensive coordinator Jerry Sandusky, who is accused of sexually abusing eight boys over 15 years. Schultz, 62, and Penn State athletic director Tim Curley, 57, were both charged Saturday with failing to report to state and county officials that a witness told them he saw Sandusky sexually abusing a naked boy in the showers of a team practice facility in 2002.
Schultz and Curley were both also charged with perjury. Lawyers for all three men say they are innocent.
Farrell told The Associated Press on Sunday that the mandated reporting rules only apply to people who come into direct contact with children. He also said the statute of limitations for the summary offense with which Schultz is charged is two years, so it expired in 2004.

Because the intention of the legislation was to only require those eyeballing rape, and not someone who was told of a rape by someone who eyeballed it...

You have to love a substantive legal theory fail when it is matched with an epic PR fail at the very same time.

Penn State coach Joe Paterno says he was only told witness had seen Jerry Sandusky doing 'something inappropriate' in the shower


Penn State Head Coach Joe Paterno released a statement today regarding the child sex abuse charges filed against his former defensive coordinator Jerry Sandusky, saying "If this is true we were all fooled."

Perjury and failure to report charges were also filed against university Athletic Director Tim Curley and Vice President for business and finance, Gary Schultz, after prosecutors say they ignored a report in 2002 from then-graduate assistant Mike McQueary that McQueary had witnessed Sandusky performing a sex act with a boy in the Penn State football locker room.

Paterno, 84, told Curley about what McQueary witnessed, but said in his statement that he was never told the specifics of what McQueary saw.

This is the statement, in full:

"If true, the nature and amount of charges made are very shocking to me and all Penn Staters. While I did what I was supposed to with the one charge brought to my attention, like anyone else involved I can't help but be deeply saddened these matters are alleged to have occurred.
"Sue and I have devoted our lives to helping young people reach their potential. The fact that someone we thought we knew might have harmed young people to this extent is deeply troubling. If this is true we were all fooled, along with scores of professionals trained in such things, and we grieve for the victims and their families. They are in our prayers.
"As my grand jury testimony stated, I was informed in 2002 by an assistant coach that he had witnessed an incident in the shower of our locker room facility. It was obvious that the witness was distraught over what he saw, but he at no time related to me the very specific actions contained in the Grand Jury report. Regardless, it was clear that the witness saw something inappropriate involving Mr. Sandusky. As Coach Sandusky was retired from our coaching staff at that time, I referred the matter to university administrators.
"I understand that people are upset and angry, but let's be fair and let the legal process unfold. In the meantime I would ask all Penn Staters to continue to trust in what that name represents, continue to pursue their lives every day with high ideals and not let these events shake their beliefs nor who they are."

It was reported that Sandusky and the 10 year old saw McQueary looking at them. I hope that image is burned in McQueary's brain forever. How he can live with himself for not helping that child, I can't fathom. How many kids continued to be victims of Sandusky's abuse after the 2002 incident that could have been prevented?

I agree he should have gone to the cops immediately (whoever it was, no one knows if it's McQ, everyone is just assuming it's him), I'm just saying that once he left the area, the guy could have gone and gotten a gun. I'm not defending him, just saying it's a fucked up thing to walk in on, and though everyone wants to think they'd know exactly what they'd do in that situation, I'm not sure anyone really does.

Considering the discovery was in the showers - I think the truth would be naked.
He saw a naked boy, Victim 2, whose age he estimated to be ten years old, with his hands up against the wall, being subjected to anal intercourse by a naked Sandusky.

Many of the comments below it (not all, of course) are pretty reasonable too, actually. I don't see how anyone could think this was anything other than earth-shattering. It's not like the guy hid this from everyone and this was the first anyone found out about it, that would be bad enough...the cover up is what will buyr the university, though.
