Its all subjective and matters of opinion on how much was ingested and how whether or not he took it knowingly.

Again, it was my OPINION that he took it knowingly because if he was given an amount of a drug used to drug someone, it was likely an amount that would have messed him up pretty good. Why would someone have a "date-rape drug" that carries such a low amount of weight that it would likely have zero side effects? You think someone buys ecstasy to drug someone but does it only in small doses that their victim wont feel it?
It's not a date rape drug. People take X to trip, not rape sorority girls. Ecstasy isn't cheap.

If Spence's story is true, this is likely how it went down: kid goes to buy some weed before the party, his dealer happens to have some X, kid buys a vial or a few pills because hey what the fuck, kid gets to the party and says "hey bros I got some ecstasy", they throw it in the punch or soda or whatever instead of waiting to take it at a club or Ikea like you're supposed to. I'm 1.5 years removed from undergrad. I've played this game before.

If Spence's parents want to sue the B1G I'd say that's their prerogative. It's really none of our business.

Frankly, it would be interesting to know how all this stuff got leaked to the press to begin with. If it was from any source other than Noah or his folks, I hope they're slammed. The kid deserves privacy.

I was under the impression the dad was the one that specified the substance.
