I believe he is a free agent. He came with a pretty hefty contract last year and I don't think that the Indians are going to re-sign for the type of money that he will be seeking. According to Paul Hoynes of the Cleveland Plain Dealer, the Indians like Carlos Pena and went to ownership to see if they could make a deal work.
However, ownership has yet to make a decision on the matter. Pena, who turns 34 in May, batted .225/.357/.462 with 28 home runs, 80 RBI and an .819 OPS over 606 plate appearances with the Cubs last season. Progressive Field is generally considered pitcher-friendly, but at least caters to left-handed power. The veteran first baseman has also reportedly drawn interest from the Rays.

I think Pena, if he plays a full season (um, right ) could either be the "good" Deer or the "bad" Deer:
1987 Deer ("good"): 134 G, 28 HR, 80 RBI, 186 Ks, .238 AVG
1991 Deer ("bad"): 134 G, 25 HR, 64 RBI, 175 Ks, .179 AVG
Yes folks, Detroit was so bad that year (actually, they weren't bad, which makes this amazing) he got 539 PAs and hit all of .179
I can see Pena doing either, but I am leaning to a "Bad Deer" at this stage
