Bucknuts and Scout Part ways

I didn't read the complaint carefully, but my limited knowledge of this suit is questions of state law (ie contracts, tort) are at the heart of it. Scout figures to get a less "down home judge" (and a broader jury pool) than if it stayed in Montgomery County, so that's why they removed it.

Looks like more may be jumping ship...

Announcement: Scout / New Message Boards & Formats / etc OU Insiders:

We were informed yesterday that the Scout Network (Fox) will change their message boards from EZ Board to some unique new board software in two weeks. They gave us a preliminary target date of January 29th.

At this time, we are absolutely opposed to this format change for OU Insider for several reasons.

Our network agreement with Scout acknowledges that we own this site, (OUinsider.com), and that we have final say over what our site looks like. However, in the past Scout has often ignored their contractual obligations and simply implemented change regardless. This repeated pattern of 'bully behavior' is the primary reason that we have given notice that we will not renew with Scout.

We will try to block this change on OUInsider.

We will do everything in our power over the next two weeks to work something out with Scout. We certainly do not want to, but we may be forced into declaring WW III and leaving the network early over this issue. We will do everything we can in the next few weeks to prevent this from happening.

Recently, the Ohio State site left the network and Scout simply retained an Ohio State site without the Bucknuts staff -- who also left. Scout has refused to take down the 'Bucknuts' name over the imposter site that remains in it's place. Obviously this is just an underhanded ploy to confuse Ohio State fans into believing that their replacement site is still the real Bucknuts.

This behavior is simply not right.

It's disturbing to think that Scout would try to confuse the Ohio State customer base by trying to hijack the site name. This issue is now in Federal Court in Ohio, and we'll support with whatever the court decides, but we believe it would be easier on everyone if Scout just renamed their replacement site.

It is our strong desire to wait until our contract expires and leave the network in some orderly fashion. That would take place in 24 months. However, we do not know at this point how the network will respond when we discuss the Message Board issue with them.

Should the worst happen here at OUInsider, and we have to go to war, all of our people will leave with us: James, Alan, Joe and all of our reporting and support staff.

Another central point of contention is who did our customers (you) subscribe to? Scout believes that 90% of you will remain with them should we leave. We believe that 90% of you will simply follow OUInsider and our staff to a new URL -- OUinsider.com. Naturally, each of you will choose to do what you want.

We have also been asked -- what happens to my subscription if you guys leave?

If you are Monthly -- nothing. You would simply sign up for Monthly on our new site.

If you are Annual pay -- we would honor your subscription until the expiration date.

What about Sooners Illustrated (Magazine)? Even if we leave, we feel that we owe our customers a quality product, regardless of our differences with Scout/Fox. We would propose that we continue to furnish editorial and photography for that magazine for 12 months. Obviously, Scout (Fox) would decide if they wanted to work with us, or go to an all out war and put out the magazine with national and scab writers.

Again, we do not plan (or want) to leave the network now.

That would be the absolute last resort, and an option that we would resist. However, at some point in time, someone has to stand up to the Bully and say - 'no more.' We honestly wish that would be someone else, but as the largest site on the Scout network, we have a responsibility to the smaller sites to resist tyranny.

and, fwiw, the new Scout message board format is HORRIBLE. You could pay a part-time high schooler to come up with something better in a week.
