QB Mauk appeals to NCAA again

CINCINNATI (AP)?Quarterback Ben Mauk is taking his case for another year of eligibility at Cincinnati back to the NCAA.
At the request of both sides, a judge in Hardin County, Ohio, postponed a hearing scheduled Friday in Mauk?s lawsuit against the NCAA. That puts the lawsuit on hold while Mauk submits new information to support his contention that a foot injury prevented him from playing his freshman year.
Mauk?s attorney Kevin Murphy said the material will be reviewed by NCAA staff as early as this weekend. Messages for comment were left Thursday with the NCAA.

NCAA says it's still considering Mauk's latest appeal for more playing time

CINCINNATI -- The NCAA said Tuesday that it's still considering quarterback Ben Mauk's latest appeal for more playing time, contrary to what it told his lawyer a day earlier.

Lawyer Kevin Murphy received a phone call Monday night from an NCAA representative, informing him that the staff had denied Mauk's request for another season of eligibility. Murphy was told that Mauk could talk to the NCAA's reinstatement committee by phone on Thursday, pleading his case for the final time.

On Tuesday, Murphy said he got another phone call from the same NCAA representative telling him the staff was still considering the matter and hadn't ruled, contrary to what he had been told.

One more chance before his NCAA options are exhausted. But, again, going back to the same committee that just rejected his appeal earlier this month.

NCAA turns down Mauk's appeal

After a couple of days of mixed signals, the NCAA told the former Bearcats' quarterback that it had turned him down for the fourth time. Now, Mauk will appeal directly to the NCAA's reinstatement committee for another season.

Mauk will talk to the reinstatement committee by phone this afternoon, a few hours before the Bearcats open their season at home against Eastern Kentucky. He expects a decision either later today or on Friday.

Is this story finally over? That's too bad; for some reason I found it very appealing.

Of course not. Mauk's motto: Never give up! Never surrender!

College football notebook: Mauk's appeal denied by judge

Wednesday, September 10, 2008 3:08 AM

Associated Press

Former Cincinnati quarterback Ben Mauk, who sued the NCAA after being denied a sixth season of eligibility, lost another appeal yesterday when a judge in his hometown of Kenton ruled against him.
Hardin County Judge William Hart refused to grant a permanent injunction allowing Mauk to rejoin the Bearcats.
Mauk, who says he missed two seasons because of injuries, was turned down by the NCAA five times before he went to court.
Kevin Murphy, an attorney for Mauk, said he hasn't decided whether to appeal.
It was unclear whether Mauk would have taken the field even if the judge had sided with him. Cincinnati officials have not allowed Mauk to practice while the case is in the courts.

I think he has moved on......

Dispatch

Former University of Cincinnati quarterback Ben Mauk apparently is headed to the Canadian Football League's Saskatchewan Roughriders. Bill Koch reported on his Cincinnati Enquirer blog that Mauk would play there and the Regina Leader-Post had a blog entry that indicated that the Kenton native will be placed on the team's practice roster this week.
Mauk repeatedly petitioned for another year of eligibility at UC because of an injury-lost season, but his request was denied.
