NCAA denies appeal by UC quarterback for another season

CINCINNATI (AP)?The NCAA won?t reconsider its decision to deny former Cincinnati quarterback Ben Mauk another year of eligibility.

The NCAA initially turned downed Mauk?s request for a sixth year of eligibility in February. But Mauk made a new appeal on grounds that he was hurt as a freshman at Wake Forest when he sat out as a redshirt.

Mauk missed all but one game in 2006 at Wake Forest with a shoulder injury. He transferred to Cincinnati and led the Bearcats to 10 victories last season.

Under NCAA rules, a player has four years of eligibility that must be used in five years.

Cincinnati said Wednesday that Mauk is continuing with appeals in hopes of getting another year of eligibility restored.

not to mention that he transfered without sitting out a year. He already used up one loophole that has been closed, no way the NCAA lets him have another year.

It wasn't really a loophole, the NCAA created the rule and knew it was in place. He took advantage of it, as did many other players. then the NCAA decided not to have the rule anymore.

I'll be honest I feel for Mauk it's not as if he has pro career ahead of him. The pain he goes through just to condition is amazing. He wants to play for the purest of reasons he loves the game.

I agree 100% about Mauk's love of the game....but the NCAA was correct in denying the request and appeal.

Mauk still waiting
Posted by BKoch at 6/30/2008 3:30 PM EDT on Cincinnati.com

This from sports information director Mike Harris: It now appears that the Ben Mauk appeals hearing will not take place this week either. Perhaps there's a good reason for all these delays, but it seems only fair that the NCAA give Mauk and UC an answer soon, what with the start of practice only about a month away. I ran into Mauk last Friday in the Lindner Center. He said he was on his way upstairs to practice the remarks he'll make to the committee.

Mauk still waiting

UC's practice looming

By Bill Koch ? [email protected] ? July 24, 2008

The waiting continues for Ben Mauk.

A little more than a week before the University of Cincinnati begins football practice on Aug. 1, the Bearcats' once and maybe future quarterback still doesn't know if the NCAA will grant him a sixth year to complete his four years of eligibility.
He doesn't even know when the teleconference that will give him the forum to plead his case to the Student-Athlete Reinstatement Committee will be held.
Mauk said he doesn't sit around agonizing over what's going to happen. But he would like to have his status resolved.
"I think it would benefit me because now I'm missing out on some job opportunities," Mauk said. "I don't know what to tell employers that are inquiring about what I'm going to do."
Mauk's request for a medical hardship waiver that would provide him with a sixth year to complete his four years of eligibility was turned down by the NCAA for the second time in 21/2 months on April 30. The NCAA said Mauk lacked documentation from his former school, Wake Forest, to support his claim that an injury prevented him from competing during his freshman year there in 2003.
This time, Mauk and UC will present their case armed with a precedent they believe closely mirrors Mauk's situation.

NCAA denies Cincinnati QB Mauk's final eligibility appeal

WEST HARRISON, Ind. -- Quarterback Ben Mauk, one of the key components in Cincinnati's rise to Top 25 prominence last season, had his final appeal for another year of eligibility turned down Friday by the NCAA.

It was the third time that Mauk's request for another season has been rejected by the NCAA.

"I'm disappointed for Ben," coach Brian Kelly said after the team's practice Friday. "But he's a pretty resilient kid. Obviously he's quite disappointed himself. But he's got a lot of good options out there."

Good grief - I thought this story was over. Fuckin' lawyers, always filing lawsuits and shit.

Cincy's Mauk taking NCAA to court over eligibility

CINCINNATI -- Quarterback Ben Mauk is not giving up his quest to play one more season at Cincinnati.

Less than a week after the NCAA rejected his final appeal, Mauk filed a lawsuit against the association. Hardin County Judge William Hart in Mauk's home area of Kenton, Ohio, has granted a temporary restraining order that says the NCAA cannot prevent him from practicing with the Bearcats.

The judge set an Aug. 22 hearing on Mauk's request for a permanent injunction. The story was first reported by WKTN-FM in Kenton.

Time to stop Ben. If you were really waiting on the NCAA, so you knew what to tell potential employers, then tell them that you'll accept their job offer...maybe tryout for an AFL team. Your college career is over.

While I loathe using lawyers and the legal system in general, I have to say I'm all for this as I'm a bit tired of the NCAA and their decisions making abilities. I find it a bit amusing that we had to have stories a couple years ago when the NCAA made a "good" decision regarding Ray Ray.
