They are so fixated on the cheeseburgers as the reason for the show-cause while overlooking that the penalties are from the deceit and/or stonewalling the investigation are why there are step penalties. Also, they are missing that the penalties are in principle (because tcun has none), not because the NCAA is trying to act tough or that they think he's going to return. It's a message saying that he's not welcome in the NCAA for at least four years.
