Shit Campus - people get the death penalty with that level of proof all the time. That's why I'm against the death penalty. Not so much that I have a problem killing assholes who deserve it, just that the lying cops and withholding DA's and even fabricating lab evidence techs in the history of this country's criminal justice system tell me that enough evidence is untrue that it is better to lock them up for life - and give the innocent ones a chance to prove their innocence. At least the guilty can rot in jail while we figure it all out.

The only thing unusual is the fact that this stuff turned up so soon.

The real crime is that he was convicted.

Yeah the justice system failed this guy for sure.

- This lady has screwed this dudes life
- She has caused harm to her two children

What an all around piece of %^$#. She is soooo sorry but it took 3-4 years for her to come clean. That is no remorse, that is sorry for being punished.

Daughter's rape lie recanted; Kalama father freed after 9 years

The Cowlitz County prosecutor says she won?t charge a Longview woman who admitted she lied when she said her father raped her ? sending him to prison for more than nine years.

Prosecutor Sue Baur says charging Cassandra Kennedy might discourage girls from reporting sexual assaults.

Now 23 years old, Kennedy says guilt prompted her to tell police in January that she lied as an 11-year-old in 2001 in Kalama.

The Daily News reports her father, Thomas Edward Kennedy, denied the allegation but was convicted by a jury and sentenced in 2002 to more than 15 years in prison.

Now 43, Kennedy was released last week and all charges against him were dismissed.

Cassandra Kennedy says she lied because she was disappointed in her father after her parents divorced.

Yeah Sue we don't want to discourage girls from ruining the lives of others..

That would be disappointing.

To be honest I'm not that worried about pursuing the woman for something she did when she was 11 years old.

What bothers me is the reasoning displayed by the (female) prosecutor.

What is your solution? Try her as an adult for actions she made as a pre-teen? Maybe send her to juvie for a couple of years?

It's a shitty situation all the way around but going full bore after this girl isn't going to tip the scales of justice to the better.

I don't know if this would work, but you could consider what she did an ongoing crime and, because she failed to come forward when she turned 18 and recant her testimony, charge her as an adult. I'm not a criminal attorney, but I do recall that some crimes are considered ongoing offenses (for instance, conspiracy).
