To Blow or Not to Blow (NTTAWWT; split from JT Barrett)

I had one DUI in California during college, and I refused to blow. It was in the old school days. They released me in the morning. Gave me my license back, my keys and directions to where they parked my car.....along with my court date. I never showed. Got an Ohio license later that year, and all was good. I did, however, come close to shitting my pants in 2001 when I got pulled over doing a 100mph high speed burn trying to get from Napa to the Oakland airport at 6 O'Clock in the AM. Cop runs my license (Ohio at the time), and I'm praying that the DUI I skated on 15 years earlier didn't come up on his SCMODS. Still missed my fucking flight.

Now, to answer the question at hand, I had a business acquaintance in Columbus get nailed in about ten years ago. I set him up with the "fixer" attorney that the big Columbus law firms use for such stuff, and this guy's advice was you NEVER, EVER blow. The consequences are a little more steep than in my college days, but you NEVER, EVER blow. One of the investors in my first company was a big (international..not Columbus level) law partner, and he got one with his brand new M5, and his firm's local fixer told him the exact same thing.

Jesus, reading back on this thread really makes me glad that I live in a city with more cabs per capita than NYC, ample public transportation and a police force that is way more interested in shaking down drug dealers for drugs and weapons that they can sell on the black market than doing traffic enforcement. Anyone gets a DUI in Chicago deserves it because you were both way, way too fucked up to be driving and way, way too stupid to leave your car parked and hold your hand up on the corner for a cab.

based on my understanding of the law (note that I do not actually work in the legal field nor did I stay at a holiday inn express last night...) is that if you have been drinking and get pulled over for ANY reason and do not want to get a dui. the only thing you can do is pull over as you should, then not respond in anyway. just pretend your mute and don't respond to anything the officer says. obviously its probably best to not give the nice officer reason to kill you. but with that said, literally do not open your mouth for any reason what-so-ever and respond to absolutely nothing, obviously within reason.

the people saying refusing to take a sobriety test is the same as testing positive for dui. im pretty semi certain that is the case currently. its my you can't verbally refuse to take the test, doing so is essentially admitting your drunk. however, failure to respond in anyway is not actually refusing. I believe that is viewed as non compliance in a police investigation. your still going to get arrested and your still going to jail. but the charge you end up with isn't a dui. at least this is what ive been told by my law enforcement friends who happen to spend far too much money on the booze.

though my personal fav method for not getting a dui is simply not driving within 12 hours of drinking any form of alcoholic beverage. 24 hours if your saw31... =P

That technique works especially well in Germany. Seriously, go to Germany and try that.
