The moment of truth is coming this summer for Tyler Moeller, and he eagerly awaits the verdict.

That does not refer to the trial of Ralph Gray Decker of St. Petersburg, Fla., this June for his alleged assault of Moeller. Moeller, an Ohio State defensive back, was punched after an incident in a restaurant last July and fell to the floor. He struck his head, suffering injuries that forced him to sit out the 2009 season and put his playing career in jeopardy.

For Moeller, the real moment of truth is coming near the start of preseason camp in August.

Moeller was cleared to take part in spring drills last month, but not for full contact. Doctors decided his brain and skull had healed sufficiently from the surgery to relieve fluid buildup as a result of the internal bleeding, but they wanted him to proceed cautiously. In August, though, there will be no holding back - assuming he is fully cleared, as he expects.

"I'm going to come out and hit somebody as hard as I can," Moeller said. "And if I am good to go after that, I'm not going to worry about it again, because you can't play football worrying about injuries."

Man pleads guilty to assaulting Ohio State football player

LARGO - A 28-year-old man pleaded guilty on Wednesday to punching Ohio State University football player Tyler Moeller in an unprovoked attack last July at Gator's Cafe and Saloon in Treasure Island.
Moeller had brain surgery after the punch, suffered stroke-like symptoms, and still is recuperating.

Ralph Gray Decker did not speak at a court hearing Wednesday, but afterward apologized to Moeller's mother, Amy, for the attack, and hugged her in a courthouse hallway. Tyler Moeller was not present ? his mother said he is preparing for final exams.

Decker will be sentenced in August, and his attorney, Sean McQuaid, said until then he will work to pay $11,000 restitution for Moeller's medical bills. He pleaded guilty on Wednesday without making a plea bargain, meaning the judge could sentence him to as much as five years in prison...

That could just be the out of pocket cost. Insurance prolly covered the rest.

If Tyler were my son, I'd have told Senor Douche-Bag's lawyer that I'd settle for only $11K if their P.O.S. client pled guilty in criminal court without a plea bargain.

I'm not saying this was done, and I don't even know if you're allowed to do that. But that's how I'd feel about it if it were me.

Meaning, he had no defense to offer, the DA was not bargaining, and he did not want the judge to hear the story from the kid who damn near died, and to see the weeping mom and sister on the stand.

Not too much of a sucker punch defense, and no plea deal, so his best option was the guilty plea and to hope for some kind of leniency for manning up and pleading.

Except I do not think it was anything more than his attorney getting him to take the least-worst option...which was pleading guilty instead of being found guilty.

DBB - you can't use threat of criminal conviction to gain an advantage in a civil suit....at least not following the rules of ethics in my hood.

EDIT: Actually, it would be giving up an advantage in a civil suit to gain a conviction; which is the flip side of the same coin. So probably not something I would allow if I were in charge of the rules (too easy to abuse); which is why I included the "I don't even know if you're allowed to" bit.

I have zero love for insurance companies, but I'd love to see them go after him for the cost. I doubt this piece of shit has anything to live for, but I'd love to see him bankrupted. Buckeye or not, you don't cold cock dudes after you provoke them. That's bush league amateur crap.

It took more than 10 months, but Amy Moeller believes the man who severely injured her son now is sorry for his actions.

Maybe that's why after a long series of continuances and delays, Ralph Gray Decker yesterday pleaded guilty to felony battery in Pinellas County (Fla.) Court.

The charge stems from an incident last July when Decker punched Ohio State safety Tyler Moeller at a Florida bar, causing Tyler to fall and hit his head. He suffered bleeding on the brain and required surgery that forced him to sit out last season.

Amy Moeller said she spoke with Decker at a court hearing this year.

"I got to explain to him what Tyler's life has been like and the pain (Decker) caused him and how he changed Tyler's life forever," Amy said. "It was very emotional for both of us. I think he is truly remorseful."

Yesterday, she and Decker hugged in a hallway outside the courtroom, she said.

"I just want things to be right," Amy said. "It seemed like the right thing to do, as a mother."

Tyler Moeller declined to comment, saying he wanted to wait until after sentencing. That will take place in August.

Decker could face up to five years in prison and a $5,000 fine. He is making arrangements to pay $11,000 in restitution, which Amy said was Tyler's out-of-pocket medical expense.

Amy also said Tyler plans to apply to the NCAA for a medical redshirt, which would give him a sixth year of eligibility. Without getting that, this fall would be his final season.

"That's extremely important to Tyler," she said. "It's one way he gets that year of his life back."

Amy yesterday echoed what Tyler and coach Jim Tressel have said, that they expect Tyler to be cleared for contact when preseason camp begins in August.
