For those who desire to become civil procedure geeks here is a LINK to a recent 4th Circuit case [WV is in the 4th Circuit] involving a breach of contract dispute between the University of Maryland and an architect who designed the new Comcast Center where the case was remanded to state court on account of the state entities not being citizens for diversity jurisdiction purposes.

Aside from this last game I like the Tigers. I love Tiger Rag and Purple and Gold as colors, football Fridays in Baton Rouge, a very traditional uniform and Everybody's All American is the best football film ever, BUT LSU is not a "year in, year out' power in the SEC and they've gone through some very long dry spells between Gov. Huey 'Kingfish" Long and Paul Dietzel, Chollie Mac and Saban/Myles.

You may note that I left Auburn and Georgia off the list for much the same reason. I would concede that all three have a better shot at becoming a what-could-be-better situation than Wisconsin or Michigan State, but given the history and money pattern of the SEC I wouldn't count on it.

If this goes back to State court, RR has problems. State judges are elected officials. If he/she lets RR off easy, they will never be re-elected. If they sides with the University they are set for life.

They are politicians, never forget that.

Michigan people wonder why this guy is so unloved.

His handling of this situation is terrible. He walked out on his team, his State and his contract and he is supposed to be able to do this with No ramifications?

This is College, he's supoosed to set the standard. He couldn't have made a worse decision and I'll bet he's regretting it.

This guy is worse than Satan, you know the guy who coaches at Alabama.

Funny blurb in the Dispatch today:

Ohio State fans interested in demonstrating their intense dislike for Michigan are being offered a $2 discount to the Wheeling (W.Va.) Nailers' "Shred Rich Rodriguez Night" on Saturday.
The Pittsburgh Penguins' affiliate is offering discounted tickets to any fan who brings a newspaper article or picture of Rodriguez, who reportedly shredded his files at West Virginia after being hired as Michigan's coach.
An industrial-sized paper-shredder will be stationed in the arena concourse for the occasion, which also includes a game with the Charlotte Checkers.
The team announced that any fan caught wearing Michigan apparel will be charged double to help Rodriguez pay his $4 million buyout to West Virginia. Attendees named Rich Rodriguez will be admitted free, unless one of them is the real Michigan coach.
In that case, he will be barred from the building and escorted to the state line.

I think we need to come up with a new handle for Lightningrod. We must ban all handle's with the word Rod in it.....unless it has some kind of expletive before or after it.

Can't believe so many people have been misreading his name all this time. It is "Lightnin' Grod".

A Grod being "a bar of soap that self-replicates and counts your loose change."

In lightin's case it counts the change VERY fast.

I think one of the most telling things I have heard recently came from a friend of mine this past week who also happens to be a WVU Alum with some internal connections at the university. Several high profile universities have offered any and all of their legal assets to WVU voluntarily as it pertains to this contract saga. Alot of eyes in Athletic Departments all over the country are keeping very close tabs on Morgantown and AA right now. This case if it goes to trial, which currently seems inevitable, sets a new precedent for any and all that follow.

Universities fear that a decision in favor of RR will diminish any chance that they have in protecting themselves from the exact same fate. If RR gets a ruling for a reduced buyout will it signal the begining of wildly inflated buyouts in coaches contracts so that the universities get at least closer to what they feel they deserve? This case may change the entire way that coaches contracts are written, it seems as though many other universities have decided that it is in their best interest to have WVU see this through.

One other thing that has stuck with me since RR's so called "offer" of 1.5 million. Turn this scenario around, every contract has a buyout for the university should they chose to terminate the contract early. Say for example RR's contract entitled him to 4 million dollars in this circumstance. Now how would he react if the university used some kind of unsubstantiated rhetoric in an attempt to absolve itself from paying him what his agreed upon contract states he is owed? And then in "good faith" offers him less than half? To me he has done more damage to his reputation with this so called "offer" than good. Just as ORD elluded to earlier in this thread, offering someone 40% of what you owe them is not a statement of your good faith. It is more a comment on your lack of integrity to meet your agreed upon responsibilities.

This situation has many times seemed as though it has reached rock bottom, my fear now is that we haven't even scratched the surface of the depths this will reach if it makes it to a courtroom. TSUN fans have to be wondering at times if the potential rewards could ever substantiate the apparent cost.

LOL!!! I earned that name. It will be 40 years on 3/31/08 since I was struck by lightning.
