There's a lot left in that case, and PSU may yet get Paterno's legacy "restored" on paper... but I don't think emails debating how to strategically proceed prove much.
All the NCAA has to counter with is "Yes, we discussed our decision extensively [due diligence] and while there were some opinions to the contrary at first, ultimately we decided that PSU had gained a competitive advantage and thus it fell within our jurisdiction."
Cynical behavior by execs isn't illegal and entirely unremarkable imo.
