It doesn't matter one fig to me if someone is raped because 'they're a woman' or because the criminal really wanted to rape a man but had to settle for what was available.

Either way the punishment should be the same.

Well Muck, you may or may not be incorrect in one basic assumption, that there is supposed to be some core logic, some consistency in the designation of criminal laws, both in subject matter and in the application of penalties.

I guess I'm saying that there never has been, and never will be, and to point out this law as an example of fallacious thinking is fine, unless you also are trying to make a point that this law is somehow different or less logical than the other laws. It is not. Here in New Orleans they just sentenced a local man to life in prison as a habitual offender due to his fourth marijuana conviction - while I continue to drink and to distribute (via gift) the same drug that was illegal during prohibition.

I mean, [Mark May], nothing about cocaine versus crack possession laws - or state versus federal criminal sentencing - makes a bit of freaking sense.

So I guess I see a fallacy in talking about fallacies here.
