The city attorney's office has sued the makers of "Grand Theft Auto: San Andreas" for allegedly hiding pornographic material inside the video game, officials said.
Rocky Delgadillo said his office sued Rockstar Games and its parent company, Take-Two Interactive Software Inc., for making misleading statements in marketing the game and engaging in unfair competition.
A telephone call made after business hours to a Take-Two spokesman in New York was not returned.
The game, released in October 2004, features characters that commit crimes such as murder, drug dealing and pimping. The game also had an embedded "mini game" in which characters could engage in explicit sexual acts.
The industry board that rates video games gave it a mature rating but would have given it an adults-only rating if it knew of the explicit content, Delgadillo said.
The game's rating was later changed and retailers, including Wal-Mart Stores Inc., Target Corp. and Best Buy Co., pulled copies from their store shelves.
But the game was re-rated only after more than 12 million units had been sold, generating about $600 million in retail sales. The city attorney's office estimated that more than 200,000 units have been sold to date in California, generating more than $10 million in retail sales.
"Businesses have an obligation to truthfully disclose the content of their products — whether in the food we eat or the entertainment we consume," Delgadillo said.
The lawsuit, filed in Los Angeles Superior Court, was part of an ongoing investigation into the marketing of video games, authorities said. The game also spurred several states to crack down on sales of mature-rated games to minors.
Delgadillo is seeking civil penalties from Rockstar Games Take-Two Interactive. He also is requesting that Take-Two and Rockstar take action to ensure full disclosure to consumers about the content of their video games.
 
It says '17+' right on the cover of the game, idiot. And on the back it says 'blood and gore, 'intense violence', 'strong language', 'strong sexual content', and 'use of drugs'. It's not Rockstar or Take-Two's fault that these suburban soccer moms and dads don't pay attention to what they're spending their on.

Weren't there two versions of the game made? a 17+ version (your run of the mill GTA moral depravity) and a M(ature) version (which had the hidden porn)?
17+ and M are the same thing. You have to be 17 to buy rated M games.

IIRC there has only been one game(before GTA:SA was re-rated) that was given a rating Adult.

It has to be pretty extreme to be rated "Adult". Hell even the game Playboy Mansion was only given a rating of "M".

There was only one version released, then they re-released it with the content removed. You have to know what you are doing to get that part of the game. Its not something where you beat this or enter a code. You actually have to take the game save, put it on a thing like Action Replay and transfer it to your computer. Then you have to get the "hack" and alter the save file. Then transfer it back to your memory card.

I don't feel this will hold up in court just for the reason that people have to alter the original game to get it. You just don't stumble upon it. If you see it, its because you wanted to see it.

Yeah, I think the original was rated "M" for mature, and then after the whole hot coffee thing came out, they re-released it as "AO" (adults only).

From my understanding, the biggest difference between the two ratings is that WalMart, Best Buy and others have a policy against selling any game rated "AO". Obviously, for a game to be sucessful, it needs to be sold on store shelves. Losing WalMart and Best Buy takes away a lot of sales opportunities.

Did anyone actually see the hidden porn? I did a real little bit of research on it, and from I read, it sounded like it was really stupid anyway, and that the characters were still clothed, just in sexual positions. Once I found out that I'd have to modify my XBox and download a patch to it in order to view it, I lost all interest. If I want to watch porn that bad, I'll just watch a porn.

The whole thing was ridiculous. First off, it was originally rated Mature anyway, so kids under 17 shouldn't have been playing it in the first place...and if there were kids playing it, their parents are the ones to blame. Second, as was already pointed out, you can't just stumble upon the Hot Coffee mod. In most cases you have to go to great lengths to alter the original game to get it, especially in the PS2 version.
I know RockStar isn't hurting for money anytime soon, but forcing them to rerelease the game under an AO label was just stupid. It was an attack on their revenue more than protecting kids from seeing something they shouldn't.
