Doesn't matter how much tomato juice you pour over it, the stink isn't going away entirely unless the whole of the odor has been removed from the situation at hand. I can't imagine a scenario where things start to go on the mend and Gee and Smith are still employed with the University. It just isn't going to happen.

If they convince the NCAA that they shouldn't be smacked with lack of institutional control and it was all truly some rogue, self minded coach (which is their plan, it seems, to paint Tressel as such), they'll keep their jobs.

If they get smacked with LOIC - get some boxes.

An Open Letter to Gene Smith
By John Porentas

The ease with which you describe your turnaround on Jim Tressel made me queasy. In your mind, it is totally justified but in large part remains unexplained other than your remark that "the situation deteriorated ." The lack of detailed explanation is both sad and alarming. Did it deteriorate because of new facts you learned, or because you simply succumbed to outside pressure? Your failure to explain clearly how it deteriorated is serious, but it was your absolute statement that you "have done nothing wrong" that almost had me running to the toilet to lose my breakfast.

The Ohio State University is an instrumentality of the State of Ohio (see O.R.C. ? 3345.011). As an instrumentality of the State of Ohio, its actions are governed generally by the same constitutional limits as is any governmental agency pursuant to
the Fourteenth Amendment to the United States Constitution.

Where press facilities are made publicly available as a source of information for newsmen, the protection afforded newsgathering under the first amendment guarantee of freedom of the press, the constitution prohibits the arbitrary denial of access for less than compelling reasons.

Thanks for posting this here BB. I read this yesterday, but I must admit it was over my head. How was the conference limited? And did this lead to a particular negative situation that would have been alleviated if more news agents had been involved?

My take on it was that John was ticked because he wasn't invited to the press conference.

The issue is whether a state government-affiliated institution can have a pc and limit which members of the press attend. If that happens, is that infringing on the right of freedom of the press? Since I'm not a constitutional lawyer, I don't have an opinion. My gut tells me John just over-reacted a bit.
